REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />June 8, 2015 <br /> <br />SUBJECT <br />Amendments to the Bair Island Road and One Marina Subdivision Landscape <br />Maintenance, and Stormwater Treatment Measures Maintenance Agreements with <br />R.C. Peninsula Park, LLC. <br /> <br />RECOMMENDATION <br />1. By motion, approve and authorize the City Manager to execute an Amendment to <br />the previously executed Landscape Maintenance Agreement for the One Marina-Bair <br />Island Road Phase 2 with R.C. Peninsula Park, LLC dated February 18, 2014 <br />2. By motion, approve and authorize the City Manager to execute an Amendment to <br />the previously executed Stormwater Treatment Measures Maintenance Agreement for <br />the One Marina-Bair Island Road Phase 2 with R.C. Peninsula Park, LLC dated <br />February 18, 2014 <br /> <br />BACKGROUND <br />R.C. Peninsula Park, LLC is the current obligee for the maintenance responsibilities of the <br />properties located at 650 through 660 Bair Island Road, and Bair Island Road, Redwood City, <br />California. These addresses are the location of the various components of the One Marina <br />Development. <br />On February 28, 2014, a Stormwater Treatment Measures Maintenance Agreement was <br />recorded with the County as Document No. 2014-017376. A Landscape Maintenance <br />Agreement was also recorded with the County as Document No. 2014-017375 on the same <br />date. <br />The subject agreements include a legal description for the properties holding the maintenance <br />responsibilities to include the four original parcels from the original One Marina subdivision <br />shown in Parcel Map No. 2011-02. One of the parcels has since been separated from the One <br />Marina Condominium project, and is being developed as a hotel with separate Landscape <br />Maintenance and Stormwater Agreements that were recorded in February 2015. <br />ANALYSIS <br />The proposed amendment to the agreements revises the legal description and redefines the <br />description of the property burdened with the responsibility of maintenance for the landscape <br />and stormwater improvements.
