In some cases, the cost of the work is offset by cost <br />recovery (for example, from developers) or may be assigned to an appropriate non- <br />general fund account. The following chart shows that through management, cost <br />recovery, and proper fund assignment, special counsel expenditures have been <br />reasonably contained under the direction of the City Attorney: <br /> <br /> <br />Blue (dark) = total expenditures <br />Yellow (light) = general fund after cost recovery or assignment to appropriate fund <br />. <br />ANALYSIS <br />Absent litigation, it is not always clear prospectively as to which services may be <br />needed or in what amount. Like a general services agreement for routine maintenance, <br />the City maintains a number of on-going legal retention agreements under which <br />different kinds of limited assignments are made. Although the City Attorney regularly <br />reports in confidential communications to the City Council on the Legal Department’s <br />work efforts and expenditures, this report is meant to provide clear documentation for <br />the annual audit of authorized expenditures in concert with the annual budget. <br />The City Attorney is seeking approval and/or ratification of certain on-going agreements <br />with a maximum annual expenditure for each agreement, with work assigned as <br />needed, as follows: <br /> <br /> <br /> $- <br /> $200,000.00 <br /> $400,000.00 <br /> $600,000.00 <br /> $800,000.00 <br /> $1,000,000.00 <br /> $1,200,000.00 <br /> $1,400,000.00 <br />2010/112011/122012/132013/14 <br />Special Counsel Expenditures <br />7.1.I. - Page 2
