He stated that he does not want to push the ordinance back any <br />further. Mayor Gee spoke about how difficult this process is becoming as the peninsula <br />becomes more crowded. He spoke about similar communities. He stated that he <br />believes this ordinance is in the right place and he's happy not to use the PD Permit. <br />He proposed using January 1, 2016 as the enactment date. He asked for further <br />clarification on the properties with creeks banks. <br /> <br />Council Member Seybert stated that his understanding is the 15% is a starting point for <br />review, and that anything steeper than that can become problematic. He noted that this <br />can be changed after some time, depending on how development goes. Council <br />Member Howard asked if there would be complications with the January 1 effective <br />date. Mr. Aknin replied that it would be fine. Council Member Bain asked when there <br />would be a review to see if the 15% threshold is working. Mr. Aknin replied that 6 <br />months or a year would give a good snapshot into how it's working out. He asked if a <br />project is denied under that process, if they could reapply under the new process if that <br />threshold is changed. <br /> <br />Council Member Seybert asked if the process would be more of a back and forth with a <br />project in order to help it conform, rather than outright denial. Mr. Aknin stated that is <br />correct; it would be similar to how Architectural Review is currently conducted. Mayor <br />Gee clarified that there will be no non-conforming lots with this ordinance. <br /> <br />M/S Seybert/Howard to accept the staff recommendation (adoption of resolution and <br />introduction of ordinance) but make the effective date of the ordinance January 1, 2016 <br />and have staff provide a report on how effective this new approach is six months after <br />effective date and revise Figure 5.7A as requested by staff. Motion carries 4-0 with <br />Vice Mayor Foust and Council Members Aguirre and Pierce recused. <br /> <br />11.
