Page 1 of 3 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />June 8, 2015 <br /> <br />SUBJECT <br />Seaport Boulevard Landscape Maintenance District - approval of City Manager's and <br />Engineer's Report, annual budget, and levy of annual assessments <br /> <br />RECOMMENDATION <br />Adopt a Resolution of Intention to: <br />1. Order the levy of annual benefit assessments; <br />2. Approve the City Manager's Report and Assessment Engineer's Report; <br />3. Approve budget and maximum annual assessment; <br />4. Call for a Property Owner's Assessment Ballot Proceeding on the budget and annual <br />assessment; and <br />5. Provide for a Notice of the Assessment Ballot Proceeding and a Public Hearing <br />thereon. <br /> <br /> <br />BACKGROUND <br />The Seaport Boulevard Landscape Maintenance District was established on July 27, <br />1987 to pay for the expense of maintaining and operating the storm water retention <br />basin and landscaping along Seaport Boulevard. Annual assessments are levied <br />against commercial properties along Seaport Boulevard and in Seaport Centre (District <br />boundary map attached). <br />On May 22, 2000 the District was ratified in conformance with Proposition No. 218, <br />which required assessments to be approved by a majority assessment ballot <br />proceeding. That same year a five-year budget was approved. Subsequently, every <br />five years or whenever assessments are levied or existing assessments are increased, <br />a majority assessment ballot proceeding is required to levy or increase the assessment. <br />Staff has prepared a City Manager’s Report and an Engineer’s Report that includes the <br />proposed annual budget, the formula for allocating the annual budget among property <br />owners, and an annual assessment spread showing the amount to be levied on each <br />parcel in the District. Staff has also met and discussed the proposed budget and the <br />upcoming assessment ballot proceeding with the property owners and their <br />representatives. <br />7.2.F. - Page 1
