Developer is the current fee owner of that certain real property consisting of <br /> approximately 2.93 acres located within the City of Redwood City, County of San Mateo, State of <br /> California,described in Exlubit attached hereto and incorporated herein by reference(the"Propert�'). <br /> B. On May 7, 2013, the Planning Commission of the City of Redwood City adopted, <br /> among other approvals,Resolurion No. 13-08,approving the Vesting Tentative Map for the construction <br /> of a two story health club with onsite surface pazking and associated site improvements (the"Project"), <br /> prepared by BKF Engineers and dated March 3,2013 ("Tentative Map"), subject to ceitain conditions of <br /> approval("Conditions"). <br /> C . The Condirions require either (1) that certain public improvements for the Project be <br /> constntcted prior to approval of the final map ("Final Map"), or (2) that Developer enter into an <br /> agreement with City providing far the future construction of such public improvements. <br /> D . Developer has submitted the Final Map and applied to City for Fina1 Map approval <br /> without having completed the required public improvements aud,therefore,will enter into an agreement <br /> with City providing for the future construction and installation of such public improvements,as required <br /> by Government Code secrion 66462(a)(1). <br /> E. Developer has submitted to City plans, specifications and drawings entitled <br /> "Improvement Plans 24 Hour Fitness, 1050 Broadway Street", prepared by BKF Engineers and dated <br /> Novsmber 11, 2013 (the "Improvement Plans"), which, in addition to other improvements, provide for <br /> certain on-site public improvements consisting of street and street light improvements, storm drain <br /> systems, domestic water systems and sanitary sewer systems for the Project (collectively, <br /> "Ixnprovements"). <br /> F.
