3 <br />6557.03/12309 <br /> <br />ARTICLE 1 <br /> <br />DEFIITIOS <br /> <br />Section 1.1 Definitions. <br /> <br />“Annexation” shall mean the process whereby Annexation Property is added to the Development <br />as additional Phases pursuant to the provisions of Section 2.8. <br /> <br />“Annexation Property” shall mean and refer to the real property which may be annexed to and <br />become a part of the Development as a future Phase pursuant to Section 2.8 of this Declaration. The <br />Annexation Property is comprised of those areas designated as Annexation Property on the Condominium <br />Plan, and may also include portions of Parcel 1, Parcel 2 or Parcel 3 shown on the Map. Annexation <br />Property may also include a portion of the Ingress Egress Easement. <br /> <br />“Annual Assessment” shall mean and refer to an Assessment against all Condominiums in the <br />Development which is levied pursuant to Section 4.3. <br /> <br />“Architectural Control Committee” shall mean and refer to the committee by that name <br />established pursuant to this Declaration and Article XI of the Bylaws, as further described in Section 7.26 <br />of this Declaration. <br /> <br />“Articles” shall mean and refer to the Articles of Incorporation of Blu Harbor Owners <br />Association, as amended from time to time. <br /> <br />“Assessment” shall mean and refer to that portion of the cost of maintaining, improving, <br />repairing, operating and managing the Development which is to be paid by each Owner as determined by <br />the Association in accordance with this Declaration. <br /> <br />“Association” shall mean and refer to Blu Harbor Owners Association, a California nonprofit <br />mutual benefit corporation, and its successors and assigns. <br /> <br />“Association Common Area” shall mean all of the Development, excepting the individual Units, <br />and excepting the Building Common Area, as further defined in Section 2.2 of this Declaration, and as <br />shown on the Condominium Plan. The term “Association Common Area” shall also mean that portion of <br />the Property described as such in a Declaration of Annexation. <br /> <br />“Association Rules” or “Rules” shall mean and refer to the rules and regulations governing the <br />use and enjoyment of the Common Area which shall be adopted by the Board from time to time. <br /> <br />“BCDC” shall mean and refer to the San Francisco Bay Conservation and Development <br />Commission. <br /> <br />“BCDC Permit” shall mean and refer to Permit No. 2014.004.00 dated November 24, 2014, as <br />recorded in the Official Records of San Mateo County on December 10, 2014 as Instrument No. 2014- <br />114104, as may be amended or supplemented from time to time. <br /> <br />“Board” or “Board of Directors” shall mean and refer to the governing body of the Association. <br /> <br />“BRE” means the California Bureau of Real Estate. <br />7.1.K. - Page 7
