8 <br />6557.03/12309 <br />“Special Assessment” shall mean and refer to an Assessment against all Condominiums in the <br />Development which is levied pursuant to Section 4.5. <br /> <br />“Stormwater Improvements” shall collectively mean (i) all best management practices described <br />in the Stormwater Treatment Measures Maintenance Agreement, and (ii) all other improvements in the <br />Development which are intended to function as part of a storm water drainage and quality system. The <br />term “Stormwater Improvements” does not include any storm water improvements or portions thereof <br />which are dedicated to the public or a public or quasi-public entity or utility company, and accepted for <br />maintenance by the public, such entity or utility company. <br /> <br />“Stormwater Treatment Measures Maintenance Agreement” shall mean that certain Stormwater <br />Treatment Measures Maintenance Agreement entered into between [Declarant] and the City of Redwood <br />City on [________, 201_] and recorded as Instrument No. [_____________] on [________, 201_] in the <br />Official Records, including any subsequent amendments or modifications thereto. <br /> <br />“Unit” shall be as defined in Section 2.2 of this Declaration, and as further described on the <br />Condominium Plan. <br /> <br />“Unit Designation” shall mean and refer to the number, letter or combination thereof or other <br />official designation of each of the Units as shown on the Condominium Plan. <br /> <br /> <br />ARTICLE 2 <br /> <br />DESCRIPTIO OF DEVELOPMET, DIVISIO OF PROPERTY, A D CREATIO OF <br />PROPERTY RIGHTS <br /> <br />Section 2.1 Description of Development. The Development consists of the Property, <br />together with the Condominium Building(s), marina basin and all other improvements located thereon. <br />As of the date of this Declaration, the Development is intended to contain 402 residential condominium <br />units. Reference is hereby made to the Map for further details concerning the Development. As of the <br />date of this Declaration, the Development is intended to include the following building types: Parcel 1 <br />shown on the Map is intended to include a “wrap” style building with a 634 space 7-level parking garage <br />structure surrounded by a 5-level structure containing 308 residential condominium units, and related <br />facilities and improvements. Parcel 1 is also intended to include a recreation center and pool facility, and <br />related facilities and improvements. Parcel 2 shown on the Map is intended to include six 9-plex “tuck- <br />under” buildings, and four 10-plex “tuck-under” buildings, containing a total of 94 residential <br />condominium units, and related facilities and improvements. <br />Section 2.2 Division of the Development Areas. The Development is hereby divided into <br />the following separate freehold estates: <br />(a) Units. Each of the Units, as separately shown, numbered and designated on the <br />Condominium Plan, consists of the space bounded by and contained within the interior unfinished <br />surfaces of the perimeter walls, bearing walls, floors, ceilings, fire boxes, windows, window frames, <br />doors and door frames and trim of each Unit. Paint, paper, paneling, wall boards, sheet rock, outlets, <br />stain, tile, carpet, hardwood floors and other finishes are considered part of the Unit. The vertical <br />boundaries of any two-story Unit shall be the unfinished surface of the floor of the lower level to the <br />unfinished ceiling of the lower level, the unfinished surface of the upper level floor to the unfinished <br />surface of the ceiling of the upper level, and any opening (e.g. stairway) which connects the two levels. <br />The area between the unfinished surface of the ceiling of the lower level and the unfinished surface of the <br />7.1.K. - Page 12
