The City requires that all persons operating such recycled water irrigation system undergo <br />system operation training provided by the City’s Department of Public Works Services. <br />(d) The Association shall be obligated to maintain those improvements designated <br />for maintenance by the Association in any landscape maintenance agreement entered into by the <br />Association or Declarant and the City of Redwood City. Further, Declarant shall enter into the Landscape <br />Maintenance Agreement in a form acceptable to the City Attorney of Redwood City for all assigned <br />landscape areas in public rights of way to be maintained and the Association shall maintain the <br />landscaping consistent with the Landscape Maintenance Agreement. Maintenance items shall include <br />planting, not limited to trees, shrubs, flowers, grass, and all appurtenances including irrigation systems <br />and pedestrian scale lighting. Upon assignment of the Landscape Maintenance Agreement by [Declarant] <br />to the Association as described in Section 2.18 of this Declaration, the Association shall be responsible <br />for all obligations of the Developer described in the Landscape Maintenance Agreement, including the <br />costs related thereto. <br />Section 5.6 Access at Reasonable Hours. For the purpose of performing the maintenance <br />and/or repairs authorized by this Article 5, the Association’s agent or employee shall have the right, after <br />reasonable written notice to the Owner (received by Owner pursuant to Section 11.13 not less than <br />twenty-four (24) hours prior to entry, unless an emergency exists, in which case no written notice need be <br />given), to enter any Unit during reasonable hours with as little inconvenience to the Owner as is <br />practicable. <br /> <br />Section 5.7 Capital Improvements by Association. The Association may purchase <br />furniture or fixtures or may construct or cause to be constructed capital improvements upon the Common <br />Area; provided, however, that the Association shall not incur in any fiscal year aggregate expenses for <br />such purchases and construction which exceed five percent (5%) of the budgeted gross expenses of the <br />Association for such fiscal year without the vote or written assent of a majority of each class of Members <br />or, in the event Class B shares have been converted to Class A shares, the vote or written assent of a <br />majority of the total voting power of the Association as well as the vote or written assent of a majority of <br />the total voting power of Members other than Declarant. <br /> <br />Section 5.8 Water System and Recycled Water System Maintenance. <br /> <br /> (a) The City of Redwood City Department of Engineering may apply the following <br />regulation on the Property, as may be described in an applicable permit for such water system: “The <br />City’s responsibility for the potable water system should end at the upstream side of the backflow device; <br />the Association should be responsible for the water system beginning at the backflow device. The City <br />will still be responsible for installation and maintenance of the water meters within Association owned <br />and maintained meter boxes.” <br /> <br />(b) Backflow Preventer. The domestic (potable) water loop system from and <br />including the mains and laterals up to the point of connection with the water meters serving the <br />Development shall be owned and Maintained by the City; provided however, the reduced pressure <br />backflow preventer device located on the lateral line between the water main and the water meters <br />serving the Development shall be owned and Maintained by the Association, in accordance with all <br />applicable Laws and applicable provisions of any maintenance manual. <br /> <br />Section 5.9 Storm Drains/Stormwater Improvements. <br /> <br />(a) Stormwater Improvements and Stormwater Treatment Measures <br />Maintenance Agreement.
