57 <br />6557.03/12309 <br /> <br />(e) Rights to use the general or Exclusive Use Common Area; <br /> <br />(f) Responsibility for maintenance and repair of the Development; <br /> <br />(g) Expansion or contraction of the Development or the addition, annexation or <br />withdrawal of property to or from the Development; <br /> <br />(h) Boundaries of any Unit; <br /> <br />(i) Reallocation of interests in the Common Area or Exclusive Use Common Area; <br /> <br />(j) Convertibility of Units into Common Area or of Common Area into Units; <br /> <br />(k) Leasing of Units; <br /> <br />(l) Imposition of any right of first refusal or similar restriction on the right of an <br />Owner to sell, transfer or otherwise convey his Condominium; <br /> <br />(m) A decision by the Association to establish self management when professional <br />management has been required previously by a Mortgagee of a First Mortgage; <br /> <br />(n) Restoration or repair of the Development (after a hazard damage or partial <br />condemnation) in a manner other than that specified in the Condominium Documents; <br /> <br />(o) Any action to terminate the legal status of the Development after substantial <br />destruction or condemnation occurs; or <br /> <br />(p) Any provisions which are for the express benefit of Mortgagees, Insurers or <br />Guarantors of First Mortgages on Condominiums. <br /> <br />For purposes of this Section 8.6, implied approval by any Mortgagee of a First Mortgage may be <br />assumed when such Mortgagee fails to submit a response to any written proposal for additions or <br />amendments to the Condominium Documents within sixty (60) days after the Mortgagee receives proper <br />notice of the proposal, provided the notice was delivered by certified or registered mail, with a “return <br />receipt” requested. <br /> <br />Section 8.7 Restrictions on Certain Changes. Except as provided by statute, in case of <br />condemnation or substantial loss to the Units and/or Common Area by fire or other casualty, unless two- <br />thirds (2/3) of all Mortgagees of First Mortgages (based on one vote for each Condominium encumbered) <br />have given their prior written approval, neither the Association nor the Owners shall be entitled: <br /> <br />(a) By act or omission, to seek to abandon or terminate the Development; <br /> <br />(b) To change the Common Interest or obligations of any Condominium for purposes <br />of levying Assessments or charges or allocating distributions of hazard insurance proceeds or <br />condemnation awards or for determining the pro rata share of ownership of each Condominium in the <br />Building Common Area; <br /> <br />(c) To partition or subdivide any Condominium; <br /> <br />7.1.K. - Page 61
