<br />ORIGINAL <br /> <br />AMENDMENT NO.3 TO AGREEMENT FOR <br />Public Information and Outreach Services <br />Redwood City Recycled Water Project <br />(Data Instincts) <br /> <br />Th~mendment No.3 is entered into and effective as of the f'J.-- day of <br />~ ' 2008, extending and amending the agreement dated August 26, <br />2 04 (the "Agreement") by and between the City of Redwood City, a charter city and <br />municipal corporation("City"), and Data Instincts, ("Consultant") (collectively, the <br />"Parties") for the Recycled Water Project - Public Information and Outreach Services. <br /> <br />RECITALS <br /> <br />A. The Parties desire to continue Agreement's scope of work and services <br />for at least 18 additional months. <br /> <br />B. The Parties have negotiated and agreed to a supplemental scope of work <br />and fee schedule, which is attached to and incorporated by this reference as <br />Exhibit "A", -Scope of Services and Exhibit "B" -Schedule of Fees. <br /> <br />NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br />contained herein, the Parties agree as follows: <br /> <br />1. In addition to those services contained in the Agreement, as may have <br />been amended from time to time, Consultant will provide those services described in <br />Exhibit "A." <br /> <br />2. That the Agreement, as may have been amended from time to time, is <br />hereby extended and shall expire upon completion of work, and Consultant will be paid <br />on an hourly basis up to the amount of Two Hundred Eighteen Thousand dollars <br />($218,000.00) The amended not-to-exceed authorization for the Agreement will <br />increase by Two Hundred Eighteen Thousand dollars ($218,000.00) from Five Hundred <br />Eighty Seven Thousand Five Hundred Seventy Five dollars ($587,575.00) to Eight <br />Hundred Five Thousand Five Hundred Seventy Five dollars ($805,575.00). <br /> <br />3. Consultant will complete all work described in Exhibit "A". <br /> <br />4. All other provisions of the Agreement, as may have been amended from <br />time to time, will remain in full force and effect. <br /> <br />5. All requisite insurance policies to be maintained by Consultant pursuant <br />to the Agreement, as may have been amended from time to time, will include coverage <br />for this Amendment. <br /> <br />Amendment to Change Scope and Fee Schedule <br />City Attorney Approved Version 090103 1 <br />
