<br /> reimburse the Developer for certain development expenses <br /> traditionally provided by the owner of property, including <br /> geotechnical studies, site survey, topographical/utility mapping <br /> and updated environmental survey or mitigation analysis, on the <br /> following conditions: <br /> a. The Agency must have approved the expense in <br /> writing prior to the expense being incurred by the Developer (or, <br /> at the Agency's sole discretion, thereafter), with such approval <br /> being as to the scope of the service, the provider of the service <br /> and the cost thereof. <br /> b. In the event that a Disposition and <br /> Development is not reached between the parties, the Developer <br /> shall submit a request for reimbursement to the Agency, <br /> accompanied by an assignment from the Developer to the Agency of <br /> all right, title and interest in and to the work product paid <br /> for, or to be paid for, by the Agency. The Agency shall, after <br /> payment to the Developer, have the right to use such work product <br /> as it may determine. <br /> B - 3 <br /> . <br />
