Subdivider shall protect; indemnify and hold harmless City <br /> and the officer and employees thereof from any and all liability or <br /> claims because of, or arising .out of, any accident, occurrence, loss, <br /> damage o� happening during the performance of any and all work herein <br /> provided for, and referred to, or the use of any article or materials <br /> in the performance. of said work, including the use of any patent or <br /> patented articles. <br /> 12. Subdivider shall pay to City the actual cost for all plan <br /> checking, engineering, inspection, construction, and other services <br /> furnished by City in connection with this subdivision. City shall <br /> furnisYi monthly statements of all charges for services performed by <br /> • City. Subdivider agrees to complete payment of such charges within <br /> ten (10) days after sending of the statement and agrees that the <br /> amount payable shall be increased by ten percent (10$) in the event <br /> payment is not made within thirty (30) days of the date of billing. <br /> 13. Should legal action be necessary to enforce any provision of • <br /> this agreement, Subdivider agrees to pay all reasonable attorney fees <br /> and costs incurred by City in connection therewith. <br /> 14. This agreement shall be recorded by City. All covenants, <br /> terms and conditions herein contained shall pertain to and run with <br /> the real property described herein, and this agreement shall apply to, <br /> bind and inure to the heirs , grantees , assignees and transferees of <br /> 5 <br />
