Code § 27383. <br /> IMPROVEMENT AGREEMENT <br /> Blu Harbor — 1 Ucceiii Boulevard <br /> THIS IMPROVEMENT AGREEMENT ("Agreement") is made and entered into on this _day of_ <br /> A . , 20(C ("Effective Date") by and between by and between RWC HARBOR <br /> CO II ,T TIES, LC, a Delaware limited liability company ("Developer"), and the CITY OF <br /> RED 01113 CITY, a charter city and California municipal corporation ("City") with reference <br /> to the fol owing facts: <br /> RECITALS <br /> A . Developer is the current fee owner of that certain real property consisting of <br /> approximately 13.21 acres located within the City of Redwood City, County of San Mateo, State of <br /> California, described in Exhibit A, attached hereto and incorporated herein by reference (the "Property"). <br /> B . On February 4, 2014, the Planning Commission of the City of Redwood City adopted, <br /> among other approvals, Resolution No. 14-02, approving the Vesting Tentative Map TM2012-02 for 411 <br /> residential units ("Project"), prepared by Sandis and dated July 7, 2013 ("Tentative Map"), subject to <br /> certain conditions of approval ("Conditions"). <br /> C . The Conditions require either ( I) that certain public improvements for the Project be <br /> constructed prior to approval of the final map ("Final Map"), or (2) that Developer enter into an <br /> agreement with City providing for the future construction of such public improvements. <br /> D . Developer has submitted the Final Map and applied to City for Final Map approval <br /> without having completed the required public improvements and, therefore, will enter into an agreement <br /> with City providing for the future construction and installation of such public improvements, as required <br /> by Government Code section 66462(a)( I ). <br /> E . Developer has submitted to City plans, specifications and drawings entitled Blu Harbor <br /> Residential Comnmnity Onsite Improvement Plans and Bair Island Road/Uccelli Boulevard Blu Harbor <br /> Offsite Improvements, prepared by Sandis and dated May 22, 2015 (the "Improvement Plans"), which, in <br /> addition to other improvements, provide for certain on-site public improvements consisting of street and <br /> street light improvements, storm drain systems, domestic water systems and sanitary sewer systems for <br /> the Project (collectively, "Improvements"). <br /> F .
