8.A. - Page 88 <br /> EXHIBIT B <br /> PROJECT DESCRIPTION <br /> I. DEVELOPER'S IMPROVEMENTS <br /> A. General <br /> The Developer agrees that the Site shall be developed and improved in <br /> accordance with the provisions of this Agreement and the plans, drawings, and related <br /> documents approved by the City pursuant hereto. The Developer, its supervising architect, <br /> engineer and contractor, shall work with City staff to coordinate the overall design, architecture <br /> and color of the improvements on the Site. <br /> B. The Project <br /> The Project consists of the development of a five -story Class A retail /office <br /> building on the Site totaling approximately 68,500 square feet with two levels of underground <br /> parking containing 88 parking spaces. A portion of the underground parking shall be located <br /> under Middlefield Road and Hamilton Street on the Public Access Parcels and shall be connected <br /> by Developer to the City -owned Jefferson Garage on both underground levels so that patrons <br /> may pass freely between the Hamilton Garage and Jefferson Garage. The Hamilton Garage will <br /> be designed to also allow for a similar connection on both levels to a future underground garage <br /> on the Winslow Parcel. The Hamilton Garage will also provide a second point of exit for patrons <br /> of the Jefferson Garage. <br /> In addition, upon completion of the Project, Developer shall be allowed to provide <br /> outdoor seating areas, landscaping and other amenities on the Winslow Triangle pursuant to an <br /> encroachment permit. <br /> The Developer shall use commercially reasonable efforts to ensure that there shall <br /> be no employee -only food preparation service facilities maintained by the office tenants and that <br /> all eating establishments located and operating on the Site are open to the public. For purposes <br /> of this Agreement, eating establishments shall not include coffee bars, snack bars, wet bars and <br /> other similar limited food service facilities intended to serve office tenants. <br /> C. Developer Fees <br /> The Developer shall be responsible for paying all applicable fees charged by the <br /> City or any entity other than the City upon the Proj ect. <br /> D.
