07/27/2015 <br /> a. Landscape Maintenance Agreement for ail assigned landscape areas in <br /> public rights of way to be maintained. Maintenance items shall include, but are <br /> not limited to, planting trees, shrubs, flowers, grass and all appurtenances <br /> including irrigation systems and pedestrian scale lighting. <br /> b. Stormwater Treatment Measures Maintenance Agreement, in a form <br /> acceptable to the City Attorney, for all on-site stormwater treatment measures <br /> associated with the project. <br /> c. Improvement Agreement, in a form acceptable to the City Attorney, to <br /> guarantee the installation of all improvements required of the project and to <br /> provide for payment of all City inspection and plan check charges associated <br /> with the installation of public and private improvements, including, but not <br /> limited to, streets, sanitary sewers, water, storm drains and street lights. <br /> d. Development Agreement for repair and replacement of street infrastructure <br /> pursuant to Condition 61 (Repair or Replace Street Infrastructure). <br /> e. Shared Parking Covenant - The applicant shall provide a shared parking <br /> covenant (in a form acceptable to the Community Development Director and <br /> the City Attorney) providing the City with assurance that the shared parking <br /> obligations under the Downtown Precise Plan with respect to the project will be <br /> met and illustrates how the garage will be operated to allow for egress from the <br /> Jefferson Parking Garage. The shared-parking covenant shall be recorded <br /> against the property along with the Final Map. <br /> 33. Roof/Architectural Easements — An easement(s) shall be reserved between the <br /> parcels for any roof overhangs or architectural features encroaching across private <br /> parcel lines. The easement(s) shall be reserved under a separate instrument in a form <br /> acceptable the City Attorney's office, and identified on the parcel map prior to map <br /> recordation. [COA][ENGINEERING] <br /> 34. Fox Theatre Easements —The Fox Theatre Parcel shall be provided sufficient access <br /> easements at all exits, or as required by the building department. <br /> [COA][ENGINEERING] <br /> 35. Map Parcelization —The parcelization of all lands (standard, airspace, and subsurface <br /> parcels) shall be done in a configuration consistent with the needs of providing sufficient <br /> maintenance and access for existing utilities, proposed utilities, public streets, and <br /> public access. Easements shall be dedicated to the City in conjunction with agreements <br /> as needed across the new parcels for those purposes, as well as for any other purposes <br /> required by the development agreement. <br /> Enctineerinq Reaorts and Survevs <br /> 36. Soils Report— Prior to submittal of construction documents, the applicant shall obtain <br /> a soils report, prepared by a licensed geotechnical engineer, in conformance with <br /> Engineering Standards, Volumes II & III.
