17.2. A�ditional Provis'wns. PerFomners will ensure that the policies of insurance required under this Agreement contain, or are endorsed to contain, the following provisions: 17.2.1 For Commercial General Liability Insurance and Automobile Liability Insurance: City, its officers, agents, volunteers and employees will be named as additional insureds. 17.2.2 Performers will obtain occurrence ooverage. 17.2.3 This insurance will be in force during the life of the Agreement and any extensions of it and will not be canceled without thiny (30) days prior written notice to City sent pursuant to the Notice provisions of this Agreement. 17.2.4. If any of the above insurance policies are "claims made" policies, then Pertormers shall, in addition, for each such policy, provide additional insurance coverage providing an additional Mro year extended reporting period for all claims arising out of the performance of this Agreemerrt. 17.3 Providina Certificates of Insurance and Endorsements. Prior to City's execution of this Agreement, Pertormers or their Agent will fumish certificates of insurance and endorsements to City. 17.4 Failure to Maintain Coveraae. If Pertormers fails to maintain any of these insurance coverages,then City will have the option to declare Pertormers in breach, or may purchase replacement insurance or pay the premiums that are due on existing policies in order to maintain the r+equired coverages. Pertormers are responsible for any payments made by City to obtain or maintain insurance and City may collect these payments from Performers or deduct the amount paid from any sums due Pertormers under this Agreement. 17.5 Submission of Insurance Policies. City reserves the right to require, at anytime, complete and certified oopies of any or all required insurance policies and endorsements. 17.6 Primarv Coveraae. For any claims related to the Services and this Agreement, the Pertormers' insurance c:overage will be primary insurance with respect to City, its offioers, agents, volunteers and employees. Any insurance or self-insurance maintained by Ciiy for itself, its officers, agents, volunteers and employees, will be in excess of PerFormers' insurance and not contributory with it. Performers will submit an endorsement evidencing that their Commercial General Liability Insurance and Automobile Liability Insurance coverages are primary and non-contributory.
