Additionally we were apprised recently of other changes to the Development <br /> Agreement that might be occasioned by an agreement between those persons who had <br /> initiated a law suit against Electronic Arts and the City of Redwood City with respect <br /> to the Environmental Impact Report and the same people who had made public <br /> indication of efforts to circulate a petition for a referendum regarding the City's <br /> approval of this project." <br /> Mayor Hartnett said "The issues that have been under discussion were reported to the <br /> Council before this evening. They were reiterated to us in written format for purposes <br /> of this evening and the Development Agreement as revised that is before us tonight is <br /> an Agreement that reflects all of the changes that have been discussed between the <br /> opponent parties and agreed to between them as wen as those that have been <br /> recommended by our staff." <br /> 2) Open public hearing; <br /> Mayor Hartnett declared the public hearing open at 9: 14 p.m. <br /> 3) Hear public comment; <br /> ~ <br /> Joe Keene, Attorney for Electronic Arts, Redwood, Inc., said he was aware that the at <br /> least some of the Council "had been informed by staff as to the status of our <br /> discussions and finally our agreement this afternoon with the various members of the <br /> Coalition for Compatible Land Use and the other plaintiffs in the pending action <br /> against the City, Flatirons and Electronic Arts." <br /> Mayor Hartnett asked Mr. Keene "Can you represent to us that there has been a <br /> settlement between and among the parties that you have mentioned, that is signed by <br /> the parties that disposes of the law suit that has been filed that contains the <br /> compromises that have been presented to us in the form of revisions to the <br /> Development Agreement?" <br /> Mr. Keene said "That agreement has been signed. It does exist. I have a copy with <br /> me.... I want to describe briefly the structure of the agre~ment because Electronic Arts <br /> Redwood is the only party to the agreement that is signed by what I win call the <br /> defendants in this action. Because we don't have the power to accomplish on our own <br /> all the things that need to be accomplished to dispose of the law suit the agreement is <br /> structured as follows: We have agreed to undertake best efforts to see that two things <br /> happen.
