We have made commitments to the community, made requirements on the <br /> developer to undertake very significant traffic mitigation, and I think the settlement in <br /> effect ratifies our decision in that regard. While I believe Electronic Arts and the City <br /> could have successfully defended the Environmental Impact law suit, I think that we <br /> would not have found a referendum actually on the ballot, and I think the project <br /> therefore could have proceeded ultimately as was approved, a business decision was <br /> made, it fits within the parameters of our public policy, and I think we can adopt it and <br /> include in our Development Agreement the revisions that have been suggested. For <br /> those reasons I certainly intend to support the motion, resolution and ordinance <br /> changes." <br /> Councilman Ruskin said "I will support the ordinance changes as well. I think our <br /> vote previously though not legitimate because of a technicality was a good vote, and if <br /> after that Electronic Arts chose as the Mayor said, chose for business reasons to create <br /> a compromise in order to not have to sustain an. . .. expensive and lengthy law suit, that <br /> is perfectly within their right to do so.... I think the vote of the Council was basically <br /> upheld by the compromise Agreement." <br /> Councilman Leipzig said "Councilman Claire had the analogy, but it wasn't quite a <br /> smoking gun. If it had been a smoking gun they would have pulled the trigger. I think <br /> they just held it to the heads of Electronic Arts, but I agree with you there.... I won't <br /> go into what I think of the tactics or what the Pilots Association or some members of <br /> the Redwood Shores Homeowners Association attempted to do. As Councilman <br /> Ruskin just mentioned it was a private matter between Electronic Arts and some <br /> people who live in Redwood city and some people who don't.... I understand your <br /> principle on this issue Councilman Claire, but I am sure you are stilI supportive of the <br /> project and I would rather have a unanimous vote for this tonight, but we do support <br /> the project strongly, and I just wanted to mention that to EA We are very much <br /> behind you and we are glad that this is moving forward." <br /> Councilwoman Buchan said that Councilman Claire's comments "are very, very <br /> important. I think this is a perfect example of a process that didn't have to happen, but <br /> the key now is that it is over with. I support what is going to happen here tonight.
