Councilman Claire referred to the claims against the City that Council Members
reviewed every week, and said that the subject trees were "law suits waiting to
happen." Councilman Claire said he loved trees, but it was the Council's
responsibility to listen to the experts and consider their advice; to do otherwise would
be a disservice to the whole community.
Councilwoman Buchan said she agreed with her coIIeagues, that this situation was a
lawsuit waiting to happen. She added that Option 2 was only a temporary fix, and it
was the Council's responsibility to resolve the issue in the best way possible, not
delay it.
Mayor Hartnett spoke in favor of Option 1, in that it remedies the hazard posed by
those trees, and it replaces the 10 trees with 38 new native and irrigated trees, planted
in fairly short order. Mayor Hartnett said that he believed this option would leave the
area in better condition than it was found.
MIS: HOWARDIBUCHAN TO ACCEPT STAFF FINDINGS THAT THE 10
REMAINING NON-NATIVE EUCALYPTUS TREES SHOULD BE REMOVED FROM
THE BORDER OF THE PARK; DIRECT STAFF TO DO SO BY NOVEMBER 15, 1996,
PRIOR TO WINTER STORM SEASON; ALSO DIRECT STAFF TO REPRIORITIZE
CURRENT PARKS PROJECTS LIST TO CREATE FUNDS TO PLANT AND IRRIGATE
38 NEW NATIVE TREES IN GARREIT PARK BY APRIL 15, 1997 (2:1 REPLANT
RATIO); ESTIMATED COSTS ARE $5,000 FOR REMOVALS, $5,000 FOR IRRIGATION
SYSTEM AND $1,500 FOR NEW TREES (CAN BE COVERED WITH TREE PLANTING
GRANT MONIES.)
CARRIED BY UNANIMOUS VOICE VOTE.
MINUTE ORDER NO. 96-241
MIS: BUCHANILA BERGE TO LIFT THE MORATORIUM ON TREE REMOVALS.
CARRIED BY UNANIMOUS VOICE VOTE.
MINUTE ORDER NO. 96-242
10) Summary of Short Term Direction and Long Term Objectives by Mayor Hartnett;
Mayor Hartnett said it had been helpful to Council to look at the policies and
procedures with respect to public and private property regarding the care and
replacement of trees. Mayor Hartnett said he believed that the Council and staff were
more sensitive to this issue based on this experience. He said the City was fortunate
to have three concerned arborists on staff, but it was also important that the Council
"was rigorous in its analysis and have staff go through hoops from time to time" to
refocus everyone on important community issues.
ADJOURNED REGULAR COUNCIL MEETING OCTOBER 7, 1996
MINUTES MINUTE BOOK NO. 54 PAGE 11
Page No. 523
