4. Amendments to Paraqraph 4 (Pavments). Paragraph 4 is hereby amended as <br /> follows: <br /> 4. PAYMENTS. Contractor will keep detailed and accurate records <br /> of all expenditures made and expenses incurred which are funded <br /> under this Agreement. Payments of funds allocated pursuant to this <br /> Agreement will be made to Contractor on a reimbursement basis as <br /> follows: (i) Contractor will submit requests for payment to the City <br /> quarterly by the 15tn day of the month electronically to the website <br /> specified by City's CDBG/HOME Program; (ii) all requests for payment <br /> will be accompanied by copies of original receipts or other proof of <br /> expenditures, and shall disclose amounts of Program Income, if any, <br /> generated by user fees; (iii) final payment request must be submitted <br /> and received by the City no later than June 1, 2017; (iv) the Program <br /> income, if any, will be subtracted from corresponding requests for <br /> payment; and (v) Program Income, if applicable, will be expended by <br /> Contractor prior to requesting reimbursements from City. <br /> 5. Amendments to Paraqraph 6 (Quarterlv Reports). Paragraph 6 is hereby <br /> amended as follows: <br /> 6. QUARTERLY REPORTS. Contractor will submit quarterly <br /> progress reports to the City describing the activities funded under this <br /> Agreement to document Contractor's success in meeting the Project <br /> objectives referenced in this Agreement. The reports will be submitted <br /> quarterly by the 15m day of the month electronically to the website <br /> specified by City's CDBG/HOME Program. The final report will be <br /> submitted no later than June 1, 2017. If Contractor fails to submit such <br /> quarterly reports on a timely basis, City may withhold payment of funds <br /> hereunder until all such delinquent reports have been submitted. The <br /> reports will include the total number of direct beneficiaries of the Project <br /> with demographic information regarding income, household <br /> composition, ethnicity, age and other data as required by City or HUD. <br /> 6. No Other Modifications. Except as specifically modified herein, the Original <br /> Agreement remains in full force and effect. To the extent that any provision of this Amendment <br /> conflicts with any provisions of the Original Agreement, this Amendment shall control. <br /> 7. Miscellaneous. The individuals executing this Amendment and the instruments <br /> referenced in it on behalf of Contractor each represent and warrant that they have the legal power, <br /> right and actual authority to bind Contractor to the terms and conditions of this Amendment. <br /> Paragraph headings and sub-Paragraph headings as used herein are for convenience only and <br /> will not be deemed to alter or modify the provisions of the Paragraphs or sub-Paragraphs headed <br /> thereby. <br /> (Signature Page Follows] <br /> ATTY/AGR/2016/AMENDMENTS/AMEND NO.1 HHDC OXFORD APTS REHABILITATION <br /> REV:06-17-16 VR <br /> Page 2 of 3 <br />
