EXHIBIT "A" <br /> USE AND SERVICES <br /> PERMITTEE'S RESPONSIBILITIES: <br /> 1. Permittee is responsible for screening, hiring and supervising qualified swimming <br /> coaches and lifeguards recognized by national life-saving and/or swimming instructor <br /> associations to be on the City's Hoover Pool ("Facilities") pool deck during programs. <br /> 2. Permittee shall be responsible for opening and closing the Facilities. <br /> 3. Permittee shall use the donated funds to Abilities United for the purposes of using these <br /> funds independently for the swim instruction to children meeting demographic <br /> requirements of the grant. Service targets include subsidized learn to swim program for <br /> up to 200 children, and inclusive swim team opportunities . Services to take place each <br /> week for at least eight weeks during the summer. <br /> 4. Permittee will use keys issued during the term of the Agreement per direction of the <br /> Department; and will pay for any lost keys and/or rekeying of the Facilities if deemed <br /> necessary to regain security of the Facilities. All keys issued to Permittee will be <br /> returned at the termination of this Agreement. If keys are not returned Permittee will be <br /> charged for the costs incurred to City for replacement and/or rekeying. <br /> 5. Permittee will not be responsible for any costs not in the normal operating expenses of <br /> the Hoover pool including, but not limited to, equipment repairs, pool repairs and facility <br /> repairs. <br /> 6. The hours of operation of the Facilities by Permittee shall be restricted to 6:00 a.m. to <br /> 7:00 p.m., Monday through Saturday. <br /> 7. Permittee shall not access Hoover pool mechanical room unless for emergency shut-off <br /> purposes. Permittee shall notify City's Building Maintenance staff for all Facilities-related <br /> failures (including, but not limited to, mechanical, electrical and/or plumbing) for <br /> instructions. <br /> 8. Permittee agrees to strictly adhere to City's daily checklist and prevent checklist of items <br /> before the Facility is opened each day of use. City shall provide checklists to Permittee. <br /> All records are to be maintained on binders/clipboards in the basketroom at all times. <br /> CITY'S RESPONSIBILITIES: <br /> 1. City agrees to maintain Hoover pool to meet water quality standards. This includes the <br /> payment to PG&E for monthly service and any chemical costs. <br /> 2.
