upon conviction thereof shall be punished by a fine not <br /> exceeding Five Hundred Dollars ($500.00) , or by imprison- <br /> ment in the County Jail of the County of San Mateo, State <br /> of California, not exceeding 90 days, or by both such fine <br /> and imprisonment, and every day upon which a violation con- <br /> tinues shall be deemed a separate offense and punishable <br /> by such. <br /> "SECTION 31. PUBLIC NUISANCE: <br /> "The operation of any food establishment without <br /> a valid permit issued pursuant to th�s ordinance or other- <br /> wise in violation of the provisions of this ordinance or in <br /> violation of the California Restaurant Act (§28520, et seq., <br /> of the Health and Safety Code) shall constitute a pub lic <br /> nuisance which may be abated or enjoined as provided by law. <br /> "SECTION 32. VALIDITY: <br /> "If any section, subsection, sentence, clause <br /> or phrase of this ordinance is for any reason held to be <br /> unconstitutional or otherwise invalid, such decision shall <br /> not affect the validity of the remaining portions of this <br /> ordinance. The Council of Redwood City hereby declares <br /> that it would have .=passed this ordinance and each section, <br /> subsection, sentence, clause and phrase thereof, irrespective <br /> of the fact that an�: one or more sections, subsections, <br /> sentences, clauses or phrases be declared unconstitutional <br /> or otherwise invalid." <br /> SECTION 5.
