35 <br />will show Company’s consent to that modification or revocation of waiver. <br />Bank may convert Company’s Account to another type of account at any time, <br />provided Bank gives Company any advance notice that may be required. <br /> <br />Monitoring and Recording Communications. <br />Bank may without liability monitor, record and retain telephone <br />conversations, electronic messages, electronic records and other data <br />transmissions between Company and Bank at any time without further <br />notice to Company, unless further notice is otherwise required by the laws <br />governing this Agreement. <br /> <br />No Fiduciary Relationship. <br />Bank’s relationship with Company concerning Company’s Account is that of <br />debtor and creditor; no fiduciary, quasi-fiduciary or special relationship <br />exists between Company and Bank. <br /> <br />Reliance on Bank Records. <br />Bank may rely solely on its records to determine the form of ownership of <br />and the Authorized Signers on Company’s Account. <br /> <br />Reordering Checks. <br />Company can reorder checks by mailing the reorder form enclosed in <br />Company’s current order of checks or by calling Bank at the telephone <br />number shown on the statement for Company’s Account. If Company or a <br />third party prints its checks, Bank shall have no liability to Company if Bank <br />is unable to process such checks by automated means. <br /> <br />Restricted transactions. <br />Company acknowledges and agrees that “restricted transactions,” as defined <br />in the Unlawful Internet Gambling Enforcement Act of 2006 and <br />Regulation GG issued thereunder, are prohibited from being processed <br />through Company’s Account or any relationship between Company and <br />Bank. In the event Bank identifies a suspected restricted transaction, Bank <br />may block or otherwise prevent, or prohibit such transaction and, further, <br />Bank may close the Account or end the relationship. <br /> <br />Transferring an Interest in Company’s Account. <br />Company’s Account may not be pledged, assigned or in any other manner <br />transferred, whether in whole or in part, without Bank’s written agreement. <br />6.1.D. - Page 77
