8. Reversion of Assets - Except for a transfer to a limited partnership, the general <br /> partner of which is MidPen Housing Corporation or an affiliate thereof for the purpose of <br /> rehabilitating the Project for continued use as affordable housing, if Contractor elects to <br /> sell the property or discontinue the affordable housing program and not perform the <br /> conditions of this Agreement Contractor shall pay to the City the sum of Three Hundred <br /> Thirty Nine Thousand, Seven Hundred Fifty Six and 00 /100 Dollars ($339, 756.00) and <br /> any additional sums due to the City pursuant to this Agreement: <br /> 9. Comaliance With Federal Laws And Requlations - Contractor, to the extent <br /> applicable to this Agreement, shall comply with the following Federal laws and <br /> regulations as set forth in 24 CFR Sec. 570.600-570.612 (September 6, 1988): <br /> a. Title VI of the Civil Rights Act of 1964, which provides that no person in the <br /> United States shall be excluded from participation in, be denied the benefits of, or be <br /> subjected to discrimination under any program or activity receiving Federal financial <br /> assistance, including community development funds, on the grounds of race, color, or <br /> national origin. <br /> b. Fair Housing Act (42 U.S.C. 3601- 20), which provides that it is the policy of <br /> the United States to provide, within constitutional limitations, fair housing throughout the <br /> United States and prohibits any person from discriminating in the sale, rental, or <br /> financing of housing on the basis of race, color, religion, sex, national origin, disabilities <br /> or familial status. <br /> c, Age Discrimination Act of 1975, which prohibits discrimination on the basis of <br /> age in the delivery of services, programs or benefits supported by Federal funds. <br /> d. Rehabilitation Act of 1973, Section 504, which prohibits discrimination against <br /> otherwise qualified persons with disabilities in the provision of programs, facilities and <br /> employment supportec�by Federal funds. <br /> e. Flood Disaster Protection Act of 1973, which provides that no federal financial <br /> assistance for acquisition or construction purposes may be approved for an area having <br /> special flood hazards unless the community in which the area is located is participating <br /> in the National Flood Insurance Program. <br /> f. Uniform Relocation Assistance and Real Property Acquisition Policies Act of <br /> 1970, which provides for relocation assistance for any family, individual, business, non- <br /> profit organization or farm displaced as a result of acquisition of property with federal <br /> funds. <br /> 10. Occupancv Reports - Annually, on June 30th of every year of the HOME <br /> affordability period stated in Paragraph 5 of this Exhibit A to the Agreement, Contractor <br /> shall provide to the City a report containing, at a minimum, the following items and <br /> information: <br /> i) Total number of HOME-assisted units that are occupied; <br /> ii) Total number of HOME-assisted units that are vacant; <br /> REV:08-14-15 RL <br /> Page 20 of 26 <br /> ATTY/AGR.2015.176/MIDPEN City Center Apts Rehab <br />
