�,�-cs <br /> (iii) the City or the operator of the Jefferson Garage shall use all commercially reasonable <br /> efforts to schedule the maintenance and repairs for periods other than Jefferson Garage <br /> Peak Periods (defined below), and (iv) except for emergency maintenance and repairs, no <br /> maintenance and repairs that will result in more than a de minimis closure or <br /> unavailability of the parking azeas shall be scheduled between the Friday before <br /> Thanksgiving and the fifteenth day of January next following, unless approved in writing <br /> by Developer and the City. <br /> E. Parking Rates for Peak Periods. <br /> Subject to Sections I-F, I-G and I-H below, the hourly rate for use of the Jefferson Garage <br /> shall be not less than five dollars ($5.00) per hour from 5 p.m. until closing Monday <br /> through Thursday, from noon until closing on Friday and all day on weekends and <br /> holidays (collectively, "Jefferson Garage Peak Periods"), provided that the such five <br /> dollar ($5.00) per hour minimum charge shall be adjusted by minimum increments of <br /> $0.50, to compensate for adjustments in the Consumer Price Index, All Items, for the San <br /> Francisco-Oakland-San Jose Area, All Urban Consumers, published by the Bureau of <br /> Labor Statistics of the United States Department of Labor (1982-1984 equals 100) <br /> ("CPI"), as more particularly described on Schedule I attached hereto and made a part <br /> hereof. <br /> F. Parking for Cinema Patrons. <br /> Project theater ("Cinema") patrons presenting validation shall be entitled to receive free <br /> parking in the Jefferson Garage for a period not to exceed four (4) hours prior to <br /> presentation of such validation at all times. <br /> G. Parkin� for Patrons of Other Project Businesses <br /> Patrons of other Project businesses presenting validation shall be entitled to receive free <br /> parking in the Jefferson Garage for a period not to exceed one (1) hour prior to <br /> presentation of such validation form at all times. <br /> H. Parkin� for Patrons of Other powntown Businesses <br /> Patrons of other powntown businesses presenting validation may receive free parking in <br /> the Jefferson Garage for a period not to exceed one (1) hour prior to presentation of such <br /> validation during Jefferson Garage Peak Periods. <br /> Atty/Agr/Agr.194 <br /> 062404 g <br />
