The Developer has submitted a p�rcel tn�p for the Property,which has been reviewed by <br /> the City Engineer�nd is being approved concumntly with dus Agreement("Final M�p"). <br /> D. The Develaper recognizes that the City's appmval of the Final Map is based on the <br /> Developer's commitment to the long ternn maintenance, repair, c�re and, if and when necessary, <br /> replacement of the Improvements, and that the Final Map would not have been approved without the <br /> �sssuzance that this A�reement wQUld be executed by the Devcloper. <br /> B.
