• <br /> unit is declared to be permanent in character and cannot he <br /> altered without the consent of all of the unit owners affected <br /> ' and seventy-five percent (7S%) of the holders of first mortgages <br /> on the units (based on one ( 1 ) vote for each first mortgage <br /> owned) , as expressed in an amended declaration. Such common <br /> interest cannot he separated from the unit to which it is <br /> appurtenant. Each unit owner may use the Condominium Common <br /> Area and Recreational Common Area in accordance with the <br /> u purposes for which they are intended without hindering the <br /> exercise of or encroaching upon the rights of any other unit <br /> owners. <br /> C. Restricted Common Areas: The following <br /> described portions of the common area,referred to as "restricted <br /> common areas", are hereby set aside and allocated for the <br /> cn <br /> exclusive use of the owner of the unit to which they are <br /> attached or assigned by unit number, on the condominium plan: <br /> v Carport space designated "P", followed by the number of the unit <br /> w to which it is appurtenant ; patio designated "PA", followed by <br /> j the number of the unit to which it is appurtenant; deck <br /> designated "D", followed by the number of the unit to which it <br /> N is appurtenant; and storage area designated "S", followed by <br /> W the number of the unit to which it is appurtenant. � <br /> } <br /> O. <br /> The following are also part of the Restricted <br /> Common Area: Stair wells appurtenant to each two story unit, <br /> consisting of that space between the upper limit of the first "� <br /> floor air space and the lower limit of the second floor air <br /> space of the unit which space provides for stair access between <br /> the two floor levels within the unit; exterior stairs appurtenant <br /> to and providing access only to a particular unit; and attic <br /> space appurtenant to the unit having access thereto. <br /> D. Parking: All common area parking spaces <br /> designated "GPS" followed by a number on the Condominium Plan, <br /> shall remain permanently available for guest parking. All <br /> common area parking spaces designated "PS", followed by a <br /> number, shall be subject to control of the Board, which may <br /> establish rules and regulations from time to time for parking <br /> therein. Carport space shall be used for parking of permitted <br /> vehicles only and not for the permanent parking or storage of <br /> boats, trailers or non-mobile vehicles of any description. <br /> The owner or owners of a unit (or their tenants in the case of <br /> a leased unit) shall not be permitted to have more than two (2) <br /> motor vehicles which are parked or regularly operated within <br /> the project. <br /> E. Recreational Common Area: The Recreational <br /> Common Area, Parcel "A" on the Map, as defined in Section 1 . 27, <br /> shall be conveyed to the Association prior to the close of <br /> escrow of the sale of the first unit in Phase I, to he held for <br /> . the benefit of all unit owners.
