Code § 27383. <br /> LANDSCAPE MAINTENANCE AGREEMENT <br /> One Marina — Bair Island Road Phase 2 <br /> YTHIS LAN CAPE MAINTENANCE AGREEMENT ("Agreement") is made and entered into <br /> this l Y day of 20 ("Effective Date"), by and between RC Peninsula Park, LLC, a <br /> Delaware limited liabi ity part cr ("Delcloper'), and the CITY OF REDWOOD CITY, a charter city and <br /> California municipal corpora on ("City") with reference to the following facts: <br /> RECITALS <br /> A. Reference is made to that certain real property situated in the City of Redwood City, <br /> County of San Mateo, State of California, known as the One Marina site and described on Exhibit "A", <br /> attached hereto and incorporated by this reference as if fully set forth herein (the "Property"). The <br /> Properly is being developed as a condominium project. The Developer expects to transfer its interest in <br /> the Property to the One Marina Owner's Association ("HOA"), a California nonprofit mutual benefit <br /> corporation, which HOA shall be ultimately responsible for the management, operation and governance <br /> of the Property. <br /> B. In connection with its development of the Property as a residential community, the <br /> Developer submitted to the City a Precise Plan, PC Permit, and Construction Documents, which include, <br /> inter all; landscaping plans for reconstructed Bair Island Road along the Property frontage ("Plans"), all <br /> of which Plans have been approved by the City. The Plans provide for installation of certain landscaping, <br /> pedestrian lighting, irrigation piping and controller, pedestrian path, and bicycle path ("Improvements") <br /> within that portion of the City owned right of way and easement area beginning at the back of the south <br /> Bair Island Road curb and extending south from there to the south side of the pedestrian path/sidewalk <br /> along the entire One Marina site frontage along Bair Island Road ("Maintenance Area") as the <br /> Improvements and Maintenance Arca arc more specifically shown on Exhibit "B" attached hereto and by <br /> this reference made a part hereof, <br /> C. Reference is made to the Landscape Maintenance Agreement for the Phase I Bair Island <br /> Road improvements, recorded in the Official Records of the County of San Mateo as document no. 2011- <br /> 115422. <br /> D, The Developer previously submitted a final map for the Property, which has been <br /> reviewed by the City Engineer and was approved concurrently with the Agreement described in Recital C. <br /> ("Final Map"). <br /> ATTYIAGR/2013,040/LANDSCAPE MAINTENANCE AGREEMENT- ONE MARINA.
