REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />September 21, 2015 <br /> <br />SUBJECT <br />Quit claim of excess real property being a portion of former right-of-way of Alden Street <br />to BEX Portfolio, LLC, and The Salvation Army. <br /> <br />RECOMMENDATION <br />1. By motion, approve and authorize the Mayor to quit claim a portion of the real <br />property formerly the right-of-way of Alden St to BEX Portfolio, LLC, a Delaware limited <br />liability company. <br />2. By motion, approve and authorize the Mayor to quit claim a portion of the real <br />property formerly the right-of-way of Alden St to The Salvation Army, a California <br />corporation. <br /> <br /> <br />BACKGROUND <br />The City vacated and abandoned a portion of Alden Street in accordance with <br />Resolution No. 7999, recorded February 13, 1978. A portion of which is the property <br />being quit claimed. The Civil Code Section 831 states that land dedicated for a public <br />right-of-way that is later vacated returns to the owner of the adjacent real property. At <br />that time, however, it as unknown that this portion of the right-of-way was held in fee by <br />the City of Redwood City. <br /> <br />This parcel was originally granted in fee to the State of California by the Tacoma Mill <br />Company, and later granted in fee to the City under a director’s deed. Even though the <br />Property comprises a small irregular portion of both the BEX Property and SA Property, <br />the ownership of the Property may not have reverted from the City to BEX and The <br />Salvation Army upon its vacation. This has necessitated the foregoing quitclaims, in <br />addition to the vacation, in order to ensure that a clear title is conveyed to BEX Portfolio, <br />LLC and the Salvation Army, which appeared to be the original intent. <br /> <br />ANALYSIS <br />The property owners have done extensive title research to determine the history of the <br />ownership of the parcels, and have delineated the appropriate parcel configuration to <br />quit claim the parcels to the appropriate entity, consistent with the previous vacation <br />documents. Due to the irregular configuration of the parcels to be quit claimed the <br />parcels do not appear to have any value to the City. It is also within the City’s interest to <br />6.1.E. - Page 1
