<br />Of the setback modifications being requested, three occur along the exterior perimeter <br />of the project boundary adjacent to neighboring properties (depicted with an asterisk in <br />Table 3 above.) <br /> <br />The rear yards of Lots 1 and 5 are directly adjacent to the side yards of 36 Finger <br />Avenue and 90 Finger Avenue. If the Project parcels (50, 80 & 88 Finger Avenue) <br />stayed in their current configuration, these property lines would remain as side lot lines <br />with required side yard setbacks of 6’. Thus, maintaining a minimum 6’ setback along <br />these property lines matches what could be built under the current standards. Further, <br />Lots 1 and 5 have been designed to provide larger side yard areas which would be <br />utilized as the usable outdoor space. Staff is therefore supportive of the requested <br />reduced rear yard setbacks for Lots 1 and 5. <br /> <br />The side yard for the proposed detached garage on Lot 7 is directly adjacent to the side <br />yard of 54 Finger Avenue. The required side and rear yard setbacks for detached <br />accessory structures are 6’. Lot 7 contains sufficient space for the detached garage to <br />be situated in a way that is compliant with the required 6’ side and rear yard setbacks, <br />therefore, Staff recommends that these PD modifications not be approved. A condition <br />of approval requiring the detached garage comply with the 6’ side and rear setbacks <br />has been included in the resolution. <br /> <br />Top of Bank <br />As described in the attached Planning Commission staff report, the City reviewed <br />disparate information as to the true location of the top of bank, and issued a letter on <br />October 2, 2014 (See Attachment 8) agreeing with the location as identified by Kamman <br />Hydrology on behalf of the Friends of Cordilleras Creek (Friends). The Applicant has <br />accepted this location and has amended the plans accordingly. <br /> <br />This change in the location of the top of bank from the previously-accepted top of bank <br />location is described in Addendum No. 1 to the EIR (See Attachment 2) and does not <br />constitute new information, new environmental impacts, or substantial increase in the <br />severity of previously identified impacts. <br /> <br />Stormwater Treatment and Use Permits <br />In 2006, Redwood City adopted the Stormwater Treatment Ordinance to “minimize the <br />discharge of pollutants in stormwater runoff and to reduce erosion and sedimentation in <br />existing streams, lagoons, and wetlands.” Section 32.12.F specifically applies to <br />properties along protected watercourses and establishes required setbacks for creek <br />8.B. - Page 5
