constructed along the side and rear lot lines of Lots 1-4. This results in a 100% <br />reduction in impervious surfaces within the creek protection setback, and an <br />increase of 48 linear feet of lot line fencing. <br /> <br />The project as described in the certified EIR included encroachments within the <br />25’ creek protection setback area (although utilizing a different top of bank <br />location). The EIR analyzed potential environmental impacts associated with the <br />development and provided mitigation measures to minimize potential impacts, to <br />provide enhanced landscaping along the creek where existing impervious <br />coverage will be removed, and to promote a more natural character to the creek. <br />Therefore, the development will not disturb riparian vegetation, but enhance and <br />add to the vegetation along and near the creek top of bank. <br /> <br />2. The development will maintain the stability of the slopes of the creek bank. <br /> <br />The proposed project includes no work or disturbance of earth within the slopes <br />of the bank. The existing retaining walls located at or near the top of bank would <br />remain in place. Further, the proposed project would remove existing structures <br />and other impervious coverage that are in close proximity to the top of bank and <br />place new structures and improvements further away from the creek. <br /> <br />The certified EIR concludes that the grading and drainage proposed as part of <br />the project will have a minimal impact on the stability of the creek bank. Further, <br />the installation of fencing along the top of bank was considered within the <br />certified EIR and found to not create an impact on the stability of the creek bank, <br />therefore, the proposed development will maintain the stability of the slopes of <br />the creek bank. <br /> <br />3. The development will be designed to avoid discharge of pollutants directly to the <br />watercourse and will assure that the discharge of runoff will be filtered over a <br />minimum of twenty-five (25) feet of vegetation or through other equivalent means <br />to the satisfaction of the Engineering and Construction Division. <br /> <br />With the removal of 5,573 square feet of structures and impervious coverage <br />within the 25’ creek protection setback area, and the placement of new structures <br />and impervious coverage further away from the top of bank, a net reduction of <br />runoff into Cordilleras Creek will occur. A minimum of 25 feet of vegetated, <br />pervious ground cover is provided on all lots along the creek. Further, the <br />drainage plan calls for all rooftop runoff as well as all drainage from the rear wall- <br />line of the proposed houses on Lots 1-4 to be treated on-site before being <br />8.B. - Page 7
