roadways if there is an approved Planned Development Permit, as here. <br />Section 30.118 states in pertinent part: "All proposed streets shall comply with the <br />following criteria: ... B. Street Widths: The minimum width of the several classes of <br />streets and highways shall conform to the schedule contained in this Section; provided, <br />however, where a planned development permit for the subject area has been <br />approved, or where the Subdivision Committee, or the Plan Review Committee, as the <br />case may be, finds that it would be in the public interest to provide an exception to the <br />precise standards contained herein such agency shall recommend a modification to such <br />standards to the Planning Commission." (Bold added.) <br />Read in context, either the developer in his his application for a Planned <br />Development Permit or a subcommittee of the Planning Commission recommends an <br />exception to the Planning Commission, and the Planning Commission has the authority to <br />grant the exception if the PDP is approved or it the subcommittees found a public interest. <br />Then, Section 30.69 comes into play, which states "[e]xceptions to any of the <br />requirements of this Chapter may be granted by the Planning Commission." In order for <br />the Planning Commission to grant the requested exception, it must make "all [three] of the <br />following findings: A. The property is of such shape or size, or is affected by such <br />topographical conditions, or is subject to such title limitations or record that it is impossible <br />or impracticable for the subdivider to comply with the requirement with which exception is <br />taken. B. The exception is necessary for the preservation and enjoyment of a substantial <br />property right of the subdivider. C. The granting of the exception will not be detrimental <br />to the public welfare or injurious to other property in the vicinity of the subject property." <br />The Planning Commission and the City Council made those findings, approved, the <br />PDP and approved the exception.
