1 <br /> <br />REPORT <br />To the Redwood City Planning Commission <br />From Planning Staff <br /> <br />April 7, 2015 <br /> <br />SUBJECT <br />Request by McGowan Development for a Planned Development Permit including <br />modifications, Use Permit, and Vesting Tentative Map including modifications for a Nine <br />Lot Residential Project located at 50, 80 and 88 Finger Avenue. <br /> <br />RECOMMENDATION <br />Hold a public hearing and adopt Resolution No. 15-07, recommending that the City <br />Council approve the Planned Development Permit PD2008-06 including requested <br />modifications, Use Permit UP2014-23, and Vesting Tentative Map TM2008-08 including <br />design modifications, based on the findings set forth in the Resolution and subject to the <br />Conditions of Approval listed therein and upon consideration of the First Amendment to <br />the Draft Focused Environmental Impact Report for the Finger Avenue Nine-Lot <br />Planned Development Project (Final EIR), dated June 2012, as certified by the City <br />Council on September 10, 2012 and subsequent Addendum No. 1, dated March, 2015. <br /> <br />BACKGROUND <br />McGowan Development has applied for a Planned Development Permit including <br />modifications to development regulations, a Use Permit to allow construction of <br />improvements within a 25’ creek protection setback, and a Vesting Tentative Map <br />including modifications to the required street width and configuration to develop a nine- <br />lot single-family subdivision on 1.69 acres of land located at 50, 80 and 88 Finger <br />Avenue in Redwood City (Project). The original project application was submitted in <br />July 2006. Appeals and litigation have brought this project back to the City a third time <br />for review and action on requested entitlements. <br /> <br />Most recently, a Superior Court of the State of California, County of San Mateo decision <br />upheld the City’s September 10, 2012 certification of the Environmental Impact Report <br />(EIR) but required revocation of previous project approvals. The court directed the City <br />to evaluate future project entitlements in accordance with the City’s Municipal Code with <br />reference to 1) Top of Bank determination, and 2) Processing of entitlements <br />(specifically, requirement of a Use Permit and the required findings for encroachments <br />within the 25’ creek protection setback). <br /> <br />On April 28, 2014, the Applicant submitted an amended Vesting Tentative Map and <br />Planned Development Permit application that addressed the court’s concerns. On <br />November 25, 2014, the Applicant submitted a Use Permit application for construction <br />of structures within the 25’ creek protection setback. The current amended application <br />retains the nine-lot configuration with a U-shaped private one-way street with access <br />from Finger Avenue. <br /> <br />Review and action on the project will be de novo. The Planning Commission previously <br />reviewed the project and made recommendations to the City Council on June 19, 2012. <br />8.B. - Page 94
