8 <br /> <br />2. The development will maintain the stability of the slopes of the creek bank. <br /> <br />The proposed project includes no work or disturbance of earth within the slopes <br />of the bank. The existing retaining walls located at or near the top of bank would <br />remain in place. Further, the proposed project would remove structures and <br />other impervious coverage that are in close proximity to the top of bank and <br />place new structures and improvements further away from the creek. <br /> <br />The certified EIR concludes that the grading and drainage proposed as part of <br />the project will have a minimal impact on the stability of the creek bank. Further, <br />using pier and grade beam foundations for the structures within 30’ of the toe of <br />bank (Lots 1-4) would result in a less than significant impact of the creek bank. <br />Therefore, the proposed development will maintain the stability of the slopes of <br />the creek bank. <br /> <br />3. The development will be designed to avoid discharge of pollutants directly to the <br />watercourse and will assure that the discharge of runoff will be filtered over a <br />minimum of twenty-five (25) feet of vegetation or through other equivalent means <br />to the satisfaction of the Engineering and Construction Division. <br /> <br />With the removal of 5,573 square feet of structures and impervious coverage <br />within the 25’ creek protection area, and placing new structures and impervious <br />coverage further away from the top of bank, a net reduction of runoff into <br />Cordilleras Creek will occur. Further, the drainage plan calls for all rooftop runoff <br />as well as all drainage from the rear wall-line of the proposed houses on Lots 1-4 <br />to be treated on-site before being directed and discharged into the City’s <br />stormdrain system located within Finger Avenue. <br /> <br />The certified EIR found that the proposed project represents an improvement <br />over existing conditions as it would reduce the amount of impervious surfaces <br />adjacent to the creek and install a new on-site stormwater system to filter, treat <br />and drain runoff from the project site and direct it to Finger Avenue at a discharge <br />rate and duration to match pre-project rates. Therefore, the development will <br />avoid discharge of pollutants into Cordilleras Creek and will filter and treat all <br />stormwater runoff on-site and discharge into the City’s existing stormwater <br />drainage system. <br /> <br />Article 42 (Use Permits), Section 42.3.B outlines the standard findings required for <br />approval of any Use Permit. The six Use Permit findings are: <br /> <br />1. That the proposed use will be consistent with the various elements and <br />objectives of the general plan and any applicable Specific and Precise Plans, and <br />zoning regulations for the subject location. <br /> <br />The proposed project is consistent with the General Plan Low Density <br />Residential land use designation and complies with applicable General Plan <br />policies for single family residential uses and densities. Low Density Residential <br />allows for up to 7 units per acre. With a total project site of 1.69 acres, the <br />maximum allowable density would be 11 units; the project proposes nine units. <br />8.B. - Page 101
