09/21/2015 2. Approval of an application shall not be conditioned on the approval of an Association, as defined in Section 4080 of the Civil Code. 3. Applications for use permits are subject to the procedures described in Article 42 of the City's Zoning Ordinance. D. Only one inspection shall be required and performed by the Building Department for Residential Rooftop Solar Energy Systems eligible for expedited review. E. The inspection shall be done in a timely manner and should include consolidated inspections. An inspection shall be scheduled within two [2] business days of a request and provide a three- [3-] hour inspection window. F. If a Residential Rooftop Solar Energy System fails inspection, a subsequent inspection is authorized but need not conform to the requirements of this ordinance. Section 3. The adoption of this ordinance is found to be categorically exempt from CEQA pursuant to Section 15061(b)(3) of the California Code of Regulations ("CEQA Guidelines"), which exempts activities where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. Section 4. If any section, subsection, sentence, clause or phrase of the ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it should have adopted the ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. Section 5. The City Clerk shall publish this ordinance in accordance with applicable law. Section 6.
