09/21/2015 <br /> 2. Approval of an application shall not be conditioned on the approval of an <br /> Association, as defined in Section 4080 of the Civil Code. <br /> 3. Applications for use permits are subject to the procedures described in <br /> Article 42 of the City's Zoning Ordinance. <br /> D. Only one inspection shall be required and performed by the Building Department <br /> for Residential Rooftop Solar Energy Systems eligible for expedited review. <br /> E. The inspection shall be done in a timely manner and should include consolidated <br /> inspections. An inspection shall be scheduled within two [2] business days of a <br /> request and provide a three- [3-] hour inspection window. <br /> F. If a Residential Rooftop Solar Energy System fails inspection, a subsequent <br /> inspection is authorized but need not conform to the requirements of this <br /> ordinance. <br /> Section 3. The adoption of this ordinance is found to be categorically exempt <br /> from CEQA pursuant to Section 15061(b)(3) of the California Code of Regulations <br /> ("CEQA Guidelines"), which exempts activities where it can be seen with certainty that <br /> there is no possibility that the activity in question may have a significant effect on the <br /> environment. <br /> Section 4. If any section, subsection, sentence, clause or phrase of the <br /> ordinance is for any reason held to be invalid, such decision shall not affect the validity of <br /> the remaining portions of this ordinance. The City Council hereby declares that it should <br /> have adopted the ordinance and each section, subsection, sentence, clause or phrase <br /> thereof, irrespective of the fact that any one or more sections, subsections, sentences, <br /> clauses or phrases be declared unconstitutional. <br /> Section 5. The City Clerk shall publish this ordinance in accordance with <br /> applicable law. <br /> Section 6.
