. , <br /> 08/24/2015 <br /> ORIGINAL <br /> RESOLUTION NO. 15442 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY MODIFYING THE MANAGEMENT DISTRICT <br /> PLAN OF THE DOWNTOWN REDWOOD CITY COMMUNITY <br /> BENEFIT IMPROVEMENT DISTRICT TO REMOVE CERTAIN <br /> PARCELS <br /> WHEREAS, the Downtown Redwood City Community Benefit Improvement <br /> District (the "District") has been established by the City pursuant to the Redwood City <br /> Community Benefit Improvement District Procedural Ordinance (Chapter 31 of the <br /> Redwood City Municipal Code), which incorporates most provisions of the Property and <br /> Business Improvement District Law of 1994 (Streets & Highways Code §§ 36600 et <br /> seq.) (the "Law"); and <br /> WHEREAS, the Redwood City Improvement Association ("RCIA") serves as the <br /> Owner's Association for the District; and <br /> WHEREAS, Section 36635 of the Law provides that RCIA may, at any time, <br /> request that the City Council modify the Management District Plan governing the District <br /> (the "MDP"); and <br /> WHEREAS, the City has received a written request from RCIA to modify the <br /> MDP to remove from the District certain condominium parcels located in a building that <br /> was not completely included within the boundaries of the District; and <br /> WHEREAS, on July 27, 2015, by its Resolution No. 15429, this Council <br /> proposed to modify the MDP to remove the parcels and set August 24, 2015 at 7:00 <br /> p.m. or as soon thereafter as the matter may be heard, in the City Council Chambers <br /> located at 1017 Middlefield Road, Redwood City, CA 94063, as the time and place for a <br /> public hearing on the proposed modification (the "Hearing"); and <br /> WHEREAS, a copy of the proposed modified MDP (the "Proposed Modified <br /> MDP"), which is incorporated herein by reference, has been placed on file in the Office <br /> of the City Clerk, and is available for public inspection; and <br /> WHEREAS, notice of the Hearing was published and mailed in the manner <br /> required by Sections 36636(a)(1) and 36636(a)(2) of the Law; and <br /> WHEREAS, at the appointed time and place, this Council held �a full and fair <br /> ATTY/RE50.3129/CC RE50 MODIFYING MANAGEMENT DISTRICT PLAN(CBID) RE50.#25442 <br /> REV:OS-19-15 PT MUFF ti 506 <br /> Page 1 of 3 <br />
