These terms apply to the three (3) year warranty and maintenance services period included in the "not to exceed" price for the Project, and to any extended warranry and maintenance services period purchased by the City pursuant to the Agreement. I. Standard Warranty Scheidt & Bachmann (Contractor) guarantees all parts, materials and workmanship during the warranty period of (3) years following the date of beneficial use by the City (Milestone 3). Warranty work due to manufacturer defects will be provided without cost to the City. Contractor expressly warrants that the PARCS systems shall conform to the drawings, specifications, data or other descriptions in the Scope of Work (Exhibit A), will be free from defects in design, material or workmanship, will be fit and sufficient for the purpose or use intended, and are new and unused. This warranty shall continue for a period of three (3) years following the date of beneficial use by the City (Milestone 3). If defective hardware is replaced by Contractor, the warranty terms will be renewed for such replacement hardware. Any PARCS system or component that, within the warranty period: (i) fails to perform in accordance with the specifications in effect at the time of original product shipment or (ii) fails as a re5ult of a defect in material or workmanship, will be repaired or replaced at the option of Contractor without charge to the City. All costs associated with the removal and/or reinstallation of a defective component shall be the responsibility of the Contractor. Warranty Documentation Scheidt & Bachmann will maintain a database detailing installed equipment and inventoried spare parts. This database will maintain an electronic audit trail of all service performed on each piece of equipment.
