IREPORT To the Honorable Mayor and City Council From the City Manager April 22, 2002 Subject Options for 2233 Middlefield Road (Opfer Property) Recommendation That the City Council approves the Development Agreement (DA) as attached. Background Council heard this issue on February 25, 2002. The staff report for that meeting is attached for your reference. At the February 25, 2002 meeting the Council opened and closed the public headng on the issue. Since the public hearing was held and closed there is no further public notice required for this action. The Opfer family has, of course,, been informed of the meeting. The motion that was approved by Council was: M/S Jordan/Howard to continue the item to a future date; extend theArchitectural Permit, preserving the pipeline status; staff to return with alternatives and ramifications on policies and provide construction cost analysis with consideration of practical alternatives to improving the entire street. Staff to include additional information on other pipeline projects in order to analyze this proposal in that context. To be included is consideration of language allowing the owner to terminate the agreement at any time prior to commencement of construction of the foundation of the building. This motion passed by unanimous voice vote. MINUTE ORDER 02-57 The City Manager further clarified that Council was not asking for re-negotiation of items with the owner but that staff would simply present options to the Council. The points in the motion will be discussed following: Architectural Permit This was extended for six months from February 25, 2002, or to the date of final action on the DA, whichever should occur first. The Opfer project's status with regard to the pipeline is thus preserved. If the Council decides not to approve any DA for this project, then the Architectural Permit for the proposed 7,500 square foot building would expire. Subsequent proposals will then -1-
