X I I <br /> Notification#1600-2013-0356-R3 <br /> Streambed Alteration Agreement <br /> Page 10 of 23 <br /> they are below ordinary high water (OHW) and are restricting the <br /> capacity of the stream channel or are causing erosion or flooding. <br /> Branches and/or limbs overhanging the channel and impacting water <br /> flows shall be properly pruned. Only those branches in the lower <br /> third of any woody plant and less than three (3) inches in diameter <br /> may be trimmed to accommodate maintenance activities. <br /> Understory ground cover and vines, such as mugwort, blackberry, <br /> and ferns, may be trimmed only as needed to accommodate <br /> maintenance activities. No bulldozers, backhoes, or other heavy <br /> equipment shall be used to remove tree branches or trees or remove <br /> sediment. No vegetation shall be removed by excavation or cutting <br /> off below the soil. All pruned material shall be removed from the <br /> area and properly disposed of. <br /> 2.18 Leave Wildlife Unharmed. If any wildlife is encountered during <br /> routine maintenance activities, said wildlife shall be allowed to leave <br /> the Project site unharmed. <br /> 2.19 Existina Access Roads. Access to the project sites shall be via <br /> existing roads and access ramps. The crane truck with bucket or any <br /> other heavy equipment shall be positioned on the existing paved road <br /> located outside the top-of-bank. <br /> 2.20 Dripline Protection. No equipment shall be operated within the <br /> dripline of trees. Protective fencing shall be placed around the <br /> driplines of those trees to prevent compaction of the root zone. <br /> 2.21 S oils. Spoil shall not be placed where it could enter the stream, <br /> riparian or wetland areas. Spoil shall not be placed over riparian or <br /> wetland vegetation except as specifically noticed to and accepted by <br /> CDFW. <br /> 2.22 Education Session before Commencement of Work. The biological <br /> monitor or qualified biologist shall conduct an education session on <br /> species that may be present at the project work site. The training <br /> shall consist of basic identification of the species, their basic habits, <br /> how they may be encountered in the work area, and procedures to <br /> follow when they are encountered. Any personnel joining the work <br /> crew later shall receive the same training before beginning work. <br /> The penalties for noncompliance of conditions in this Agreement <br /> shall be relayed to all project personnel. <br /> 2.23 Stop Work Authoritv. The biological monitor or qualified biologist <br /> shall have the responsibility and authority of stopping the project if <br /> any crews or personnel are not complying with the provisions <br /> outlined in this Agreement. <br /> Page 16 of 30 <br />
