consequences of that. He stated that he does not want to push the ordinance back any
further. Mayor Gee spoke about how difficult this process is becoming as the peninsula
becomes more crowded. He spoke about similar communities. He stated that he
believes this ordinance is in the right place and he's happy not to use the PD Permit.
He proposed using January 1, 2016 as the enactment date. He asked for further
clarification on the properties with creeks banks.
Council Member Seybert stated that his understanding is the 15% is a starting point for
review, and that anything steeper than that can become problematic. He noted that this
can be changed after some time, depending on how development goes. Council
Member Howard asked if there would be complications with the January 1 effective
date. Mr. Aknin replied that it would be fine. Council Member Bain asked when there
would be a review to see if the 15% threshold is working. Mr. Aknin replied that 6
months or a year would give a good snapshot into how it's working out. He asked if a
project is denied under that process, if they could reapply under the new process if that
threshold is changed.
Council Member Seybert asked if the process would be more of a back and forth with a
project in order to help it conform, rather than outright denial. Mr. Aknin stated that is
correct; it would be similar to how Architectural Review is currently conducted. Mayor
Gee clarified that there will be no non-conforming lots with this ordinance.
M/S Seybert/Howard to accept the staff recommendation (adoption of resolution and
introduction of ordinance) but make the effective date of the ordinance January 1, 2016
and have staff provide a report on how effective this new approach is six months after
effective date and revise Figure 5.7A as reque ted by staff. Motion carries 4-0 with
Vice Mayor Foust and Council Mem Aguirre and Pierce recused.
.
