The detrimental effects of such expanded use include noise, air <br /> pollution, and visual impacts from the parking lot lighting. <br /> 17. Said detrimental effects do not, on balance, offset the purported <br /> benefit of diverting some on-street parking to the off-street parking lot. Similarly, <br /> the mitigation measures included in the use permit as issued by the Zoning <br /> Administrator do not, on balance, sufficiently alleviate the negative effect of the <br /> Project upon adjoining properties. <br /> 18. The Project, as presently designed, would be detrimental to the <br /> health, safety, peace, morals, comfort, and general welfare of persons residing <br /> or working in the neighborhood of the Project and would be detrimental or <br /> injurious to property or improvements in said neighborhood (Zon. Ord. § 42.3). <br /> Conclusions <br /> 1. The appeal should be, and is hereby, granted, and the decision of the <br /> Zoning Administrator to issue the use permit is hereby reversed. <br /> 2.
