~'. .f ORIGINAL Î . AMENDMENT NO.3 TO EXTEND AND AMEND AGREEMENT FOR AFTER SCHOOL PROGRAM SERVICES (CITY OF REDWOOD CITY AND REDWOOD CITY SCHOOL DISTRICT) (CITY PROVIDING SERVICES) ."J.. This Amendment No.3 is entered into and effective as of theV~ day of June, 2005, extending and amending the Agreement dated September 8, 2003 (the "Agreement") by and between the City of Redwood City, a charter city and municipal corporation of the State of California ("City"), and the Redwood City School District ("District") (collectively, the "Parties") for after school program services. RECITALS A. On June 29, 2004, the Parties executed Amendment No.1 to the Agreement for After School Program Services to increase compensation paid to City. B. On January 12, 2005, the Parties executed Amendment No.2 to the Agreement for After School Program Services to alter the Agreement's scope of work and fee schedule to include the following schools: Fair Oaks, Hawes, John Gill, Selby Lane and Roosevelt, to ratify work previously completed and to extend the Agreement for a period of one year from June 20,2004 to June 20,2005. C. The Parties have negotiated and agreed to the acceptance of new one- time 21st Century Grant Funds for the 2004/2005 school year, in the amount of Thirty- Nine Thousand Forty-Nine Dollars and Sixty-One Cents ($39,049.61) to be spent by June 30, 2005, thereby increasing the existing "not-to-exceed amount" as described in Amendment No.2 to Two-Hundred Ninety-Six Thousand Nine-Hundred Sixty-Six Dollars and Sixty-One Cents ($296,966.61). D. The Parties have further negotiated and agreed to extend the Agreement for a period from June 20,2005 to June 30, 2006, with a revised not-to-exceed payment for the extended period in the amount of Two Hundred Fifty-Seven Thousand Nine Hundred Seventeen Dollars ($257,917). NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, the Parties agree as follows: 1. The not-to-exceed Agreement amount for the 2004-2005 school year will be increased by Thirty-Nine Thousand Forty-Nine Dollars and Sixty-One Cents ($39,049.61) to a total not-to-exceed amount of Two-Hundred Ninety-Six Thousand Nine-Hundred Sixty-Six Dollars and Sixty-One Cents ($296,966.61). Said funds will be spent no later than June 30, 2005 and in the manner described in the attached Exhibit "A," which is incorporated herein by reference. 2.
