<br />ATTY/RESO.3157/601 Marshall Appeal 8-Story Project <br />REV: 11/10/15 VR <br />Page 3 of 22 <br />Courthouse at 2200 Broadway; and <br /> <br />WHEREAS, at the June 30, 2015 public hearing, the Commission determined <br />that the proposed Vesting Tentative Map, Downtown Planned Community Permit <br />including two guideline deviations, and Parking In-Lieu Fee Application would further the <br />purposes of and appropriately implement the City of Redwood City General Plan, <br />applicable provisions of the Redwood City Municipal Code, the City Zoning Ordinance <br />and Downtown Precise Plan, and the Nine-Story Project, and approved the Nine-Story <br />Project; and <br /> <br />WHEREAS, three appeals were filed with the City during the 15-day appeal <br />period by 1) J&S Management c/o Tanya Gulesserian, Adams, Broadwell, Joseph & <br />Cardozo, 2) Richard and Sally Keyes, and 3) Geoffrey T. Carr (collectively, Appellants) <br />challenging the Planning Commission’s approval of the Nine-Story Project; and <br /> <br />WHEREAS, the matter was duly noticed for a de novo public hearing before the <br />City Council on September 28, 2015; and <br /> <br />WHEREAS, on September 28, 2015, the City Council conducted a duly noticed <br />de novo public hearing in accordance with all applicable requirements of the <br />Subdivision Map Act and the Redwood City Municipal Code, all applicable <br />requirements of the State Planning and Zoning Law, the City Zoning Ordinance and <br />the Downtown Precise Plan, to consider the appeals of the Nine-Story Project, and <br />received and considered oral and documentary evidence on the appeals and <br />application; and <br /> <br />WHEREAS, the City Council, with knowledge that the Applicant had recently <br />negotiated settlement agreements with each of the three Appellants, voted 6-0 (Howard <br />recused) to continue the public hearing in order for Staff and the City Council to review <br />the settlement agreements; and <br /> <br />WHEREAS, two of the three settlement agreements include a reduced project <br />consisting of an 8-story, 105’ tall, 124,220 square foot office building with two levels of <br />underground parking, indoor bicycle storage for 78 bicycles, a total of 255 on-site <br />automobile parking spaces, and satisfaction of the remaining 118 required parking <br />spaces through the payment of in-lieu fees (Eight-Story Proposal); and <br /> <br /> <br />WHEREAS, the matter was duly noticed for the continued public hearing before <br />the City Council on November 16, 2015; and <br />7.C. - Page 15
