ATTY/RESO.3157/601 Marshall Appeal 8-Story Project
REV: 11/10/15 VR
and in a manner approved by the City Engineer pursuant to City ordinance chapter
29, article III.
101. Streets surrounding project site shall be restored to the satisfaction of the City
Engineer at project completion. When this requires pavement restoration (such as a
slurry seal), Applicant shall consult with the City Engineer to receive the preferred
layout of pavement markings.
102. If all or a portion of the site is within a Special Flood Hazard Area (as shown on the
latest FEMA Flood Insurance Rate Maps in effect at building permit issuance), upon
completion of the structure, the elevation of the lowest floor (including basement
when applicable) shall be certified by a registered professional engineer or land
surveyor, and verified by the City’s Building Inspector to be properly elevated. Such
certification and verification shall be provided to the Floodplain Administrator.
Where required by Chapter 41 of the City’s municipal code, the Applicant shall also
submit certification by a registered professional engineer or architect that the
standards for elevation and floodproofing required by that Chapter have been
satisfied.

Prior to Final Occupancy:
103. Prior to issuing a certificate for building occupancy, the applicant shall provide a final
transportation demand management (TDM) program (acceptable to the City
Engineer) which outlines program elements to be implemented by property
management and by the tenant(s). The program shall include an annual reporting
requirement detailing parking utilization rates, TDM program use, and employee
mode choice, due on December 1st. The reporting requirement will continue until the
project’s parking garage reaches an average weekday occupancy of 95% and
thereafter for three six years. Whenever the project’s average weekday parking
occupancy reaches or exceeds 95%, the property owner will have 3 months to revise
and resubmit their TDM program to the City, outlining how the program will further
incentivize a reduction in vehicle trips to the site. Project shall collect (utilizing
sensors, loop detectors or equivalent technology) and make publicly available,
realtime garage occupancy data (via a parking app or other means deemed
appropriate by the City.)
104. A “Right to Downtown Operations” disclosure must be provided to all tenants as put
forth in Section 2.2.6 of the DTPP prior to signature of any lease or sales.
105. Red curb paint and "No Parking" signage shall be installed by the applicant as a part
of this project at certain locations upon confirmation of Fire Department connections
and fire hydrants.

Section 7. This Resolution is effective upon its adoption.

* * *

7.C. - Page 33
