The Successor Agency further directs staff, when remitting the LAS <br /> Funds, to expressly state the Successor Agency's intent in remitting such funds — that <br /> the Successor Agency is remitting the LAS Funds under protest and coercion to avoid <br /> the penalty threatened by SB 107, and not voluntarily or by way of compromise. SB <br /> 107 requires the Successor Agency to pay the obligations that the DOF had established <br /> through the DDR determination process as being owed by the Successor Agency by <br /> December 31, 2015, and penalizes the Successor Agency if full payment has not been <br /> made by disallowing a finding of completion. SB 107 compels this payment irrespective <br /> of the pending litigation between DOF and the Successor Agency concerning these <br /> funds, and the Successor Agency expressly reserves its rights to continue challenging <br /> the DOF DDR determination through its pending appeal in the California Court of <br /> Appeal for the Third District (C076431) and as otherwise permitted by law. <br /> Section 4.
