<br /> <br />ATTY/ORD.419/SIDEWALK CAFÉ ORDINANCE AMENDMENT <br />REV: 12-7-15 PT <br />Page 1 of 2 <br />ORDINANCE NO. ______ <br />ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />AMENDING SECTION 33A.15 OF THE REDWOOD CITY CODE TO CHANGE <br />THE DEFINITION OF “SIDEWALK CAFE AREA” <br /> WHEREAS, the City Council originally approved Chapter 33, Article II, Section 33A.15 of <br />the Redwood City Code (hereinafter, “Section 33A.15”) on June 27, 1977 and amended Section <br />33A.15 on November 29, 1993 and October 28, 2002; and <br /> <br />WHEREAS, the City Council deems it to be in the public interest to expand the definition <br />of “Sidewalk Cafe Area” in Section 33A.15 to include all of the Downtown Precise Plan Area as <br />described in Section i.1.2 of the City’s Downtown Precise Plan; and <br /> <br />WHEREAS, the proposed amendment is comprised of changes to the definition of <br />Sidewalk Cafe Area and correction of typos. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY DOES <br />ORDAIN AS FOLLOWS: <br />Section 1. The recitals set forth above are true and correct, and are hereby incorporated <br />herein by this reference as if fully set forth in their entirety. <br /> Section 2. The City Council hereby finds that the proposed Amendment to Section 33A.15 <br />(the “Amendment”) is in the public interest. The text of the Amendment is attached hereto as <br />Exhibit A and incorporated herein by reference. <br /> Section 3. The Amendment has been reviewed with respect to applicability of the <br />California Environmental Quality Act ("CEQA") and the State CEQA Guidelines (California Code <br />of Regulations, Title 14, Sections 15000 et seq.). The City Council hereby determines that the <br />Amendment is exempt from CEQA pursuant to the categorical exemption for Minor Alterations in <br />Land Use Limitations enumerated in California Code of Regulations, Title 14, Section 15305. <br /> <br /> Section 4. The City Council of Redwood City hereby adopts the Amendment by adding <br />the text shown in double underline (example) and deleting the text shown in strikeout (example), <br />as provided in Exhibit A. Wording in brackets ([example]) is information only and is not to be <br />included in the published ordinance. <br /> Section 5.
