<br /> 4.6 <br />MEMORANDUM FROM THE CITY ATTORNEY/AGENCY GENERAL COUNSEL <br /> CONCERNING A CLOSED SESSION BEFORE THE <br /> CITY COUNCIL OF THE CITY OF REDWOOD CITY AND <br /> THE REDWOOD CITY REDEVELOPMENT AGENCY <br />TO: Honorable Mayor, Members of the City Council and <br /> Members of the Agency Board <br />FROM: Stan T. Yamamoto, City Attorney/Agency General Counsel <br />SUBJECT: Closed Session - Existing Litigation [Government Code §54956.9] <br /> Case Names: Wilson & Wilson v. City of Redwood City, et al. <br /> [San Mateo County Superior Court Case Nos. 418250, 429131] <br />A closed session will be held on July 12, 2004, for the purpose of conferring with and/or <br />receiving advice from your legal counsel conceming existing litigation which has been formally <br />initiated to which the Council, City and Redevelopment Agency are parties. [Gov't. Code <br />§54956. 9( a)] <br />The City Attorney / Agency General will provide you with a status report on these particular <br />cases. <br />If the City Council/ Agency Board authorizes the City Attorney / General Counsel to defend, or <br />seek or refrain from seeking appellate review or relief, this determination shall be disclosed <br />immediately following this closed session. If the City Council / Agency Board authorizes <br />initiation or intervention, such authorization shall be disclosed immediately following this closed <br />session and the public advised that the action, defendants and other particulars may be <br />disclosed upon request after the action is formally commenced. [Go v 't. Code §54957.1(a)(2)]. <br />If the City Council/ Agency Board accepts a settlement offer signed by the opposing party, the <br />substance of the settlement shall be disclosed immediately following this closed session. <br />[Gov't.
