6.1.B. - Page 1
REPORT
To the Honorable Mayor and City Council
From the City Manager
January 11 , 2016
SUBJECT
Sidewalk Easement Deeds granted by Ricky Hung Ngo and Yung Le for the properties
at 353 and 355 Alameda De Las Pulgas
RECOMMENDATION
By motion, approve the Sidewalk Easements, and authorize the City Manager to, upon
receipt of a signed Deeds, accept the Sidewalk Easement Deeds granted by Ricky
Hung Ngo and Yung Le for the properties at 353 and 355 Alameda De Las Pulgas,
execute the Certificate of Acceptance for such Deeds, and modify the content of the
Sidewalk Easement Deeds as necessary to receive signed Deeds
BACKGROUND
On July 28, 2014 the City Council approved and authorized the City Manager to enter
into an Improvement Agreement with Ricky Hung Ngo and Yung Le to cover the cost of
sidewalk improvements between Harding Ave and the Hetch Hetchy right-of-way. The
sidewalk improvements are associated with the development of 353 and 355 Alameda
De Las Pulgas. Per the agreement, the property owners are obligated to pay the cost
for their frontage improvements and the cost of the right-of-way improvement design for
the full length of the project. During the approval of the plans for the development of the
properties, City staff determined that a dedication would be required for the sidewalk
improvements.
ANALYSIS
The improvement plans prepared for the original development had identified that a
sidewalk easement would be necessary for the installation of the proposed sidewalk.
City staff completed preliminary design work to identify the required dedication, and
prepared the necessary documentation. Accepting the dedication of the sidewalk
easement at this time will avoid additional steps in the future, as the sidewalk project
must be fully constructed five years after the effective date of the agreement (August
18, 2019). The improvement plans for the development of the properties have also been
reviewed and approved by City staff based on the considerations of the future sidewalk
improvement design.
The easement presented for approval is limited to the right of ingress and egress for
public purposes. This will meet the City's current and future needs for the sidewalk
improvements and ensure that the area remain free of structures.
