6.1.B. - Page 1 <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> January 11 , 2016 <br /> SUBJECT <br /> Sidewalk Easement Deeds granted by Ricky Hung Ngo and Yung Le for the properties <br /> at 353 and 355 Alameda De Las Pulgas <br /> RECOMMENDATION <br /> By motion, approve the Sidewalk Easements, and authorize the City Manager to, upon <br /> receipt of a signed Deeds, accept the Sidewalk Easement Deeds granted by Ricky <br /> Hung Ngo and Yung Le for the properties at 353 and 355 Alameda De Las Pulgas, <br /> execute the Certificate of Acceptance for such Deeds, and modify the content of the <br /> Sidewalk Easement Deeds as necessary to receive signed Deeds <br /> BACKGROUND <br /> On July 28, 2014 the City Council approved and authorized the City Manager to enter <br /> into an Improvement Agreement with Ricky Hung Ngo and Yung Le to cover the cost of <br /> sidewalk improvements between Harding Ave and the Hetch Hetchy right-of-way. The <br /> sidewalk improvements are associated with the development of 353 and 355 Alameda <br /> De Las Pulgas. Per the agreement, the property owners are obligated to pay the cost <br /> for their frontage improvements and the cost of the right-of-way improvement design for <br /> the full length of the project. During the approval of the plans for the development of the <br /> properties, City staff determined that a dedication would be required for the sidewalk <br /> improvements. <br /> ANALYSIS <br /> The improvement plans prepared for the original development had identified that a <br /> sidewalk easement would be necessary for the installation of the proposed sidewalk. <br /> City staff completed preliminary design work to identify the required dedication, and <br /> prepared the necessary documentation. Accepting the dedication of the sidewalk <br /> easement at this time will avoid additional steps in the future, as the sidewalk project <br /> must be fully constructed five years after the effective date of the agreement (August <br /> 18, 2019). The improvement plans for the development of the properties have also been <br /> reviewed and approved by City staff based on the considerations of the future sidewalk <br /> improvement design. <br /> The easement presented for approval is limited to the right of ingress and egress for <br /> public purposes. This will meet the City's current and future needs for the sidewalk <br /> improvements and ensure that the area remain free of structures. <br />
