<br />immediate threat to the public health, safety, and welfare requiring this interim Urgency
<br />Ordinance; (2) this Ordinance is necessary for the immediate preservation of the public
<br />peace, health, and safety as set forth herein; and (3) hereby declares and imposes a
<br />temporary moratorium for the immediate preservation of the public health, safety and
<br />welfare as set forth below:
<br />
<br />A. No marijuana cultivation facility or commercial cannabis activity may be
<br />established, operated, commenced, opened, or initiated in any zoning district in the City
<br />of Redwood City.
<br />
<br />B. No use permit, site development permit, tentative map, parcel map,
<br />variance, grading permit, building permit, building plans, zone change, business license,
<br />or other applicable permit will be accepted, approved, or issued for the establishment of
<br />a marijuana cultivation facility or commercial cannabis activity.
<br />
<br />C. As used in this Ordinance, the following definitions apply:
<br />
<br />1 “Commercial cannabis activity” shall have the meaning set forth in
<br />Business and Professions Code section 19300.5(k).
<br />
<br /> 2. “Cultivation” means any activity involving the planting, growing,
<br />harvesting, drying, curing, grading, or trimming of marijuana.
<br />
<br /> 3. "Marijuana" means all parts of the plant Cannabis, whether growing
<br />or not; the seeds thereof; the resin extracted from any part of the plant; and every
<br />compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or
<br />resin. It includes marijuana infused in foodstuff, and concentrated cannabis and the
<br />separated resin, whether crude or petrified, obtained from marijuana. It does not include
<br />the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the
<br />seeds of the plant, any other compound, manufacture, salt, derivative, mixture, or
<br />preparation of the mature stalks (except resin extracted therefrom), fiber, oil, or cake, or
<br />the sterilized seeds of the plant that are incapable of germination.
<br />
<br /> 4. “Marijuana cultivation facility” means any business, facility, use,
<br />establishment, property, or location where the cultivation of marijuana occurs.
<br />
<br /> D. Any use or condition caused or permitted to exist in violation of any of the
<br />provisions of this Ordinance shall be and is hereby declared a public nuisance and may
<br />be abated by the City pursuant to the procedures set forth in Article 50 of this Code.
<br />
<br />SECTION 4. Effective Date and Duration. Pursuant to Government Code
<br />section 65858(b), this Ordinance shall take effect immediately but shall be of no further
<br />force and effect 45 days from its date of adoption unless the City Council, after notice and
<br />public hearing as provided under Government Code section 65858(b) and adoption of the
<br />findings required by Government Code section 65858(c), subsequently extends this
<br />Ordinance.
