<br /> Hearing having been duly noticed and held by this Council on July 18, 1994, and the <br /> matter having been continued to August 1, 1994, on the appeal of Norton Brothers <br /> Enterprises, dba Expresso Lane ("Appellant") of the decision of the Zoning Administrator <br /> to approve the application of Mr. Jeff Titterington of Expresso Express Company <br /> ("Applicant"), for a use permit to replace an existing drive-through structure and associated <br /> business with a free-standing structure for use as a drive-through facility offering specialty <br /> coffees for sale to the public (the "Project") at 528 Woodside Road, Redwood City, <br /> California (the "Property"), the Appellant, the Applicant, the Zoning Administrator, and all <br /> other persons interested in the matter having been heard and having been given the <br /> opportunity to be heard, and this Council having fully considered the matter; <br /> NOW, THEREFORE, this Council hereby finds, concludes and orders as follows: <br /> FINDINGS <br /> 1. The Property is located in the CN (Neighborhood Commercial) zoning district (S 13.1 et <br /> seq., Ordinance No. 1130, as amended, the Zoning Ordinance ofthe City of Redwood City [all <br /> section references herein are to said ordinance unless otherwise indicated]). <br /> 2. Applicant applied for a use permit pursuant to the provisions of Sections 13.4 and 42.2 to <br /> permit the operation of the Project from a commercial coach structure to be placed in the parking <br /> lot of the neighborhood shopping center located at the Property. The structure would not contain <br /> bathroom facilities for use by patrons or employees. Vehicular access to the structure would be <br /> provided from existing driveways providing ingress and egress to the shopping center parking lot <br /> from and to Woodside Road. <br /> 3. The Zoning Administrator issued the use permit on May 26, 1994, after hearing duly <br /> noticed and held on May 11, 1994. Appellant filed timely appeal of the issuance of the permit by <br /> letter dated May 31, 1994. <br /> Appellant, through its appeal, objects to the issuance of the use permit on the grounds that <br /> inadequate or illegal provision has been made for restroom facilities, inadequate provision has <br /> been made for vehicular access/egress from the Project such that traffic congestion may occur on <br /> Woodside Road, and Applicant may take advantage of an existing roof sign to erect a sign <br /> prohibited by the City's sign regulations. <br /> 4. The use permit, as issued by the Zoning Administrator, includes the following pertinent <br /> conditions: <br /> "2. That the Applicant obtain an Architectural Permit for the proposed structure, including <br /> all proposed signage prior to release of the Building Permit. Roof signs are disallowed. <br /> Any additional signage shall require approvals from the Planning Division. <br /> "3. That the Applicant maintain, for the duration of subject operation, valid agreements from <br /> applicable parties for the utilization of adjoining bathroom facilities.
